Telecommunications Act <br /> <br />Citation: VerizQn Wireless Personal Communications LP v. Board of <br />County Com'rs of Sarasota County., 2007 WL 2702331 (M.D. Fla~ 2007) <br /> <br />FLORIDA (09/14/07)-Verizon wanted to build a wireless communica- <br />tion facility in Sarasota County. To that end, it applied for a special use <br />exception with the board of county commissioners. <br />After a hearing, the. board voted to deny the application. The board's <br />decision stated only that the request was inconsistent with the county's <br />comprehensive plan and did not meet the criteria of the county's zoning <br />regulations. Verizon sued the board in court, arguing that it's decision. vio- <br />lated the federal Telecommunications Act of 1996. <br />In pertinent part, the Act stated that all decisions related to applica- <br />tions for zoning permits had to be "in writing and supported by substan- <br />tial evidence in a written record."
