, CASE #--L-

CONSIDER AMENDING SECTION 4 OF THE CITY'S CHARTER
IN ORDER TO ESTABLISH A UNIFORM ELECTION DATE
WHEN FILLING COUNCIL VACANCIES
By: William K. Goodrich, City Attorney

Background:

For sometime the Charter Commission has been considering amendments to Chapter 4 of the
. Charter which Chapter is titled "Nominations imd Elections". The reason for an amendment would
be to eliminate the need for a special election on a non-typical election date, but rather have ALL
elections in November. Enclosed are the previous case and proposed amendment plus a new
proposed amendment which is based" on the Charter Commission's meeting on December 5, 2006.

One of the issues discussed on September 20 was how much time is needed for filing, publications,
postings, etc. for elections. Staff has received the Elections Calendar for 2008 and will bring it to
the meeting in case there are questions relating to timing.

Enclosures:

December 5, 2006 Charter Case and proposed amendment
December 5,2006 Charter Commission's Minutes
New proposed alternate Charter Amendment language for discussion

Charter Commission Action:

Based on discussion

Reviewed by:

City Attorney .
City Clerk

Charter:

11/15/07
