Chairperson Bawden inquired whether sewer and water could be extended through the trail
corridor, and City Engineer Jankowski replied that it could.

Discussion ensued regarding the City Council's February 13 review of this matter.

John Peterson, Good Value Homes, stated City Council really wanted the Planning Commission to
take a fresh look at this plat. Since there was indication that some of Council thought L'unonite
Street should extend to 149th Avenue, Good Value Homes wants to keep open the option of where
147th Avenue intersects C.R. #56. Mr. Peterson asserted that although this is not a deal breaker
issue, if he were to have his preference, he would suggest that 147th not be finished out to C.R.
#56 but just bring Limonite north to 149th. He asserted that this might not be the preference of the
neighbors, and this was really the Planning Commission's 'call'.

Motion by Commissioner Thorud and seconded by Commissioner Deemer to recommend that City
Council grant preliminary plat approval to Pondview, wherein 147th Avenue terminates on the east
property line of the commercial property and Limonite Street is extended out to 149th Avenue.

Motion carded. Voting Yes: Chairperson Bawden, Commissioners Thorud, Deemer, Holland,
LaDue, and Terry. Voting No: None.

Case #6: Request for Preliminary Plat Approval of Sunfish Estates; Case of
Good Value Homes

Zoning Administrator Frolik stated that Good Value Homes is requesting preliminary plat approval
of Sunfish Estates, which consists of approximately 12 acres proposed to be subdivided into 25
single family urban residential lots. The property is located on the southeast side of Sunfish Lake.
Earlier this evening the Board of Adjustment granted a variance to the size of non-riparian lots.
Park dedication will consist of a cash payment with a credit for path construction along the rear of
Lots 14, 15 and 16. The developer will also be required to construct a transportation trail along
Sunwood Drive, adjacent to the plat.

Chairperson Bawden inquired if the requirement for easement on the southem end of plat for a trail
corridor was a recommendation from the Park and Recreation Commission.

Ms. Frolik replied that the Park and Recreation Commission wanted some opportunity for a view
of the lake.

Commissioner Holland noted the trail that will be running along Sunwood Drive, and questioned
the need for two trails with the same view.

Commissioner Deemer viewed this as forcing private property owners to have a trail.

Commissioner Holland questioned whether this proposed trail goes through water, and
Commissioner Deemer replied that it is fairly dry land.

City Engineer Jankowski reminded the Planning Commission that this is a scaled-back
compromise of what was originally proposed. However, it has been scaled back to the extent
where we need to question whether this is really needed.

John Peterson, Good Value Homes, agreed that this was a compromise from what was originally
requested. He stated that he has been against the trail all along. He explained that it is possible to
grant an easement to the pubic without deeding the land to the public, however, the legitimate
question is where is the trail going and what do you do when you get there. He agrees with the
discussion during the public hearing on this matter, and that is that this trail doesn't do much.

Planning Commission/March 4, 1996
