2. Mr. Craig Carlson, 7160 175th Avenue NW, cited three issues as follows: <br /> <br />1) <br /> <br />Questioned existence and legality of the easement. Mr. Peterson's property was <br />contracted to deed in 1989. In 1990 he purchased the property in which the sales <br />agreement stated that the "seller would do a warranty deed." Mr. Carlson claims no <br />easement was officially registered per documents he was required to obtain as part of <br />the property purchase agreement. <br /> <br />2) <br /> <br />Mr. Carlson referred to wording, "easement for driveway purposes." His <br />understanding of its implications are that one can drive across it, but not improve it <br />and/or turn it into a road. <br /> <br />3) <br /> <br />The fill material used for expansion of the roadway is very fine grade. Mr. Carlson <br />believes it will not adequately accommodate continued traffic. <br /> <br />Chairperson B awden reminded Mr. Carlson determination of the easement's legal existence <br />was not part of the Commission's order of business. <br /> <br />Mr. Ron Hunt, installer of original road and culvert (done in 1988 or 1989), refuted claims <br />about the road, adding he was careful no to alter the height of drainage. As well, he claims <br />witnessing the signing of paperwork by Gerry Jacobs establishing the easement. <br /> <br />Mr. Jack Peterson, 16600 Kangaroo Circle, stated he purchased the land in question in 1989 <br />and had the road created in September, 1989. <br /> <br />ADJOURNMENT <br /> <br />Motion by Commissioner Holland and seconded by Commissioner Deemer to close the public <br />hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden,'Commissioners Holland, Deemer, Jensen, <br />LaDue, Terry, and Thom& Voting No: None.
