Voting No: Mayor <br />Hardin, Councilmembers Beahen and Peterson. <br /> <br />Motion by Councilmember Peterson and seconded by Mayor Hardin to send the proposal back to <br />the Planning Commission with 147th coming out to County Road #56 and not show Limonite <br />terminating at 148th Avenue. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Peterson and Beahen. Voting No: <br />Councilmembers Beyer and Zimmerman. <br /> <br />Councilmember Beyer asked if this action would require a public hearing. <br /> <br />Ms. Frolik answered no, this is the way the road alignment was originally sent to Council. <br /> <br />John Peterson stated he would be comfortable going back and "running this by" the Planning <br />Commission and he would just as soon have it be a public hearing. <br /> <br />Councilmember Beyer suggested that Mr. Peterson should not have to pay for an additional public <br />heating since this was a Council re-order. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Beahen to send this back to the <br />Planning Commission for a public hearing and that all costs related to this public hearing be picked <br />up by the City. <br /> <br />Motion carded. Voting Yes: Mayor Hardin, Councilmembers Beyer, Beahen, Peterson and <br />Zimmerman. Voting No: None. <br /> <br />Councilmember Zimmerman stated he did not see a reason why we are rezoning this plat. <br /> <br />Mr. Goodrich stated that would be the findings of fact. <br /> <br />Councilmember Zimmerman asked what is the reason for the rezoning. <br /> <br />Mr. Goodrich again replied that the findings of fact state the reason and they are the official record. <br /> <br />Case #21: Request for Preliminary Plat Approval of Brandseth; Case of Blaine <br /> Edmundson <br /> <br />Zoning Administrator Frolik stated that Brandseth is located in the southwest comer of the <br />intersection of 153rd Avenue and T.H. #47. The plat consists of 22 acres proposed to be platted <br />into 40 single family urban residential lots and one 8.75 acre outlot reserved for future commercial <br />development. The majority of the property is zoned B- 1 Business except for a small portion along <br />the south plat boundary which is zoned R-1 Urban Residential. The developer has made proper <br />application to rezone some of the property to R- 1 Urban Residential. All lots meet minimum area <br />requirements and minimum width requirements are met either at the street frontage or building <br />setback line. The plat will receive access from 153rd AvenUe and all lots will receive access from <br />interior streets. The plat provides for the platting of 152nd Avenue to the west boundary to <br />provide future access to City-owned property. The City is requesting an additional 27 feet of fight- <br />of-way along T.H. g47; the preliminary plat propOses to dedicate 17 feet. The developer has <br />requested that if there is to be a transportation impact fee, that the value of the additional 10 feet of <br />fight-of-way be credited toward any transportation impact fee due. <br /> <br />City Council/February 13, 1996 <br /> Page 20 of 32 <br /> <br /> <br />
