In response to the second item, language was added to require that vehicles and <br />equipment stored or parked on a property are registered to persons residing on the property. <br /> <br />Discussion ensued pertaining to short term visits (the vehicle would not be registered to a person <br />residing at the property) and also the time needed to come into compliance. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beahen to direct staff to add <br />language to deal with short term visiting and to include a construction season to come into <br />compliance. The Planning Commission should then hold a public hearing in June on this <br />ordinance. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmember Peterson, Beahen and Beyer. <br />Voting No: Councilmember Zimmerman. <br /> <br />Case #5: U.S. West Easement <br /> <br />City Administrator Schroeder reported that U.S. West Communications, Inc. approached the City <br />with a request to receive an easement for purposes of setting a switching cabinet at Sunfish Lake <br />Boulevard and the Burlington Northern Railway. They have offered the City $850 for that <br />easement and that is a significant amount of money. We should not experience any cost in granting <br />the easement, but $850 is more than fair. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Beahen to authorize the Mayor <br />and City Administrator to enter into an easement agreement with U.S. West Communications <br />pursuant to the case presented. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Beyer, Beahen, Peterson and <br />Zimmerman. Voting No: None. <br /> <br />Case #6: Update on Charter Commission <br /> <br />City Attorney Goodrich stated that the Charter Commission met on April 18 and elected to propose <br />two alternative questions for the special election ballot. The Charter Commission does not have the <br />authority to make any amendments to the contents of the petition nor does Council have the <br />authority to change what's submitted by the Charter Commission. The Charter Commission's <br />questions must also be presented at a special election. By scheduling the election for May 21, <br />1996, as was requested by staff, all publication requirements can be met. Anoka County will work <br />with the City with regard to absentee ballots - we will be a couple days short for that. He asked <br />that Council review the fom~at of the ballot and approve that and to authorize the election. <br /> <br />Ben Deemer, 14501 Sunfish Lake Boulevard NW, Ramsey, stated he is again present to speak <br />about what he considers an error in procedure. He presented the Recording Secretary with a <br />handout of his presentation. See Exhibit "A". <br /> <br />Terry Hendriksen, 15631 Ramsey Boulevard NW, Ramsey, stated he does not have a prepared <br />statement but that he would try to address a couple of Ben's points and the Charter action. 1) Ben <br />is saying this should go to the Charter Commission and the City Clerk certifies the petition. If Ben <br />were correct and this went to the Charter first, the Clerk would not have had it (the petition) to <br />certify that there was a sufficient number of voters. It would be sitting in the hands of the Charter <br />Commission - it's an impossible situation. 2) The State Law will prevail over the City's Charter. <br />The events which occurred in the past, on the City Attorney's ruling, states that we have a right to <br />expect an election in 90 days. That 90 days starts on February 27. It was brought up at the <br />Charter meeting that they have the right to present alternatives. Mr. Hendriksen disagreed with <br />that. He stated, however, let's assume their reading is correct. That would allow them to propose <br /> <br />City Council/April 23, 1996 <br /> Page 8 of 17 <br /> <br /> <br />
