During this process, Larry Holmberg has sold the
Amusement Center property to Arnold Holmberg. This suit has been pending in court for six
years relating to Ordinance #90-23 relating to adult uses. The action today determined our
ordinance constitutional and we can enforce it; however, Holmberg has 30 days to again appeal the
decision.

2) Moratorium on Applications for a CUP for Group Homes

Motion by Councilmember Beyer and seconded by Councilmember Beahen to direct staff and the
City Attorney to research and advise the City Council of the legality of placing a moratorium on
applications for a conditional use permit for group homes serving more than 8 persons.

Motion carried.
