5) Schedule 1997 Community Events Finance Officer Hart presented a schedule for the 1997 community events and requested Council approve of it. Motion by Councilmember Beahen and seconded by Councilmember Zimmerman to approve the schedules for the 1997 Community Events. Motion carried. Voting Yes: Mayor Hardin, Councilmembers Beahen, Zimmerman, Beyer and Peterson. Voting No: None. MAYOR/COUNCIL INPUT 1) City of Ramsey versus Arnold Holmberg City Attorney Goodrich reported that the court affirmed the finding of a summary judgement in the City of Ramsey versus Arnold Holmberg. During this process, Larry Holmberg has sold the Amusement Center property to Arnold Holmberg. This suit has been pending in court for six years relating to Ordinance #90-23 relating to adult uses. The ordinance was determined constitutional and Mr. Holmberg appealed to the 8th Circuit Court. After the Federal Court determined it to be constitutional, Holmberg again appealed. The action today determined our ordinance constitutional and we can enforce it; however, Holmberg has 30 days to again appeal the decision. 2) Moratorium on Applications for a CUP for Group Homes Motion by Councilmember Beyer and seconded by Councilmember Beahen to direct staff and the City Attorney to research and advise the City Council of the legality of placing a moratorium on applications for a conditional use permit for group homes serving more than 8 persons. Motion carried. Voting Yes: Mayor Hardin, Councilmembers Beyer, Beahen, Peterson, and Zimmerman. Voting No: None. ADJOURNMENT Motion by Conncilmember Beahen and seconded by Councilmember Beyer to adjourn the meeting. Motion carried. Voting Yes: Mayor Hardin, Councilmembers Beahen, Beyer, Peterson and Zimmerman. Voting No: None.
