Councilmember Peterson conmaented he would hope that Mr. McLafferty was concerned about <br />what they are doing on other people's property too. <br /> <br />Mayor Hardin stated that in the past, the Council has asked the applicant to supply County or State <br />results of inspections - he inquired if Mr. McLafferty would have a problem doing that. <br /> <br />Mr. McLafferty answered that he is leery about how many more hoops the City would make him <br />jump through. This is his home and his kids. He is willing to cooperate and he would be glad to <br />do that but he has really paid through the nose to have more children. The City has been sending <br />him bills and calling his neighbors and calling the Police Department. He asked for some <br />semblance of fairness. <br /> <br />Councilmember Beyer stated that any kind of investigations for CUP, the applicant is asked to pay. <br /> <br />Mr. McLafferty expressed a problem with the billing and stated that he would take that to court too. <br /> <br />Council suggested that items be added to the conditional use permit that the City get copies of all <br />the inspection reports. <br /> <br />Mr. McLafferty stated that last time he went to court, they found the City's actions to be arbitrary <br />and capricious. He stated that it's like saying that foster children are not the same as other children <br />and that most of the complaints have come from a woman who lives behind him whose daughter is <br />in prison for child molestation. He hoped the taxpayers remember how much money is being <br />spent to keep two children from getting a home. All these issues should have been addressed a <br />year and a half ago. A meeting was scheduled, then canceled. The City Attorney's law was clear, <br />the City Adnfinistrator was trying to make it a zoning issue. He stated his permit was denied but <br />issues were not addressed. He hoped the citizens remember the one who voted for this - there was <br />only one who voted in support. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Zimmerman to adopt <br />Resolution #96-05-131 adopting Findings of Fact #0401, as amended by Attorney Goodrich, <br />relating to Patrick McLafferty's request for a CUP for a foster home for a maximum of eight <br />youth. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Beyer, Zimmerman, Beahen and <br />Peterson. Voting No: None. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Zimmerman to adopt <br />Resolution #96-05-132 approving Patrick McLafferty's request for a CUP, as amended which <br />includes a term to read that all inspection reports will be provided to the City and that this permit <br />will again be reviewed by City Council on November 26, 1996, for a group foster home and <br />declaring terms of same. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Beyer, Zimmerman and Beahen. <br />Voting No: Councilmember Peterson. <br /> <br />Case #2: Adopt Ordinance Amending Chapter 6 of the City Code Other <br /> Prohibited Parking <br /> <br />City Administrator Schroeder stated that this ordinance came about because of parking concerns <br />relating to the Game Fair.
