4) Northland Security Sign Proposal City Administrator Schroeder stated that the City has been approached by Northland Security Bank to determine interest in participation in a scrolling message board at the bank's location of 142nd and T.H. #47. Motion by Councilmember Beahen and seconded by Councilmember Beyer to ratify the Finance Committee's recommendation which is as follows: Inquire what would be available to the City for a cost of $3,000 to $6,000 and to also let the bank know that the City is not interested in participation until the intersection of 142nd and T.H. #47 is improved. Motion carded. Voting Yes: Mayor Hardin, Councilmembers Beahen, Beyer and Zimmerman. Voting No: None. Absent: CouncilmemberPeterson. 5) Looping Watermain in Conjunction with T.H. #47/C.R. #116 Intersection Project Finance Officer Hart stated that, at present, the City utilities have water lines on both sides of T.H. #47, however, a watermain break south of 142nd Avenue would require interrupting service to all utility customers on that side of the highway. The commercial community is rapidly expanding and many of these businesses are dependent on water service from the City to provide integral services associated with their businesses. The T.H. g47/C.R. #116 intersection project provides a unique opportunity to loop the watermain at C.R. #116 and thereby allow for the ability to back feed these areas. Looping the watermain in conjunction with the project would realize a substantial savings. Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to adopt Resolution g96-08-210 authorizing the installation of watermain along C.R. #116. Motion carded. Voting Yes: Mayor Hardin, Councilmembers Zimmerman, Beyer and Beahen. Voting No: None. Absent: CouncilmemberPeterson. 6) Consider Settlement with Anoka Ramsey Sport Center Finance Officer Hart explained that Mr. John Noard of Anoka Ramsey Sport Center has contended for the last several years that his property is being improperly charged for water and sewer trunk related charges in relation to City Project #87-19. He feels that these charges should have been covered under site improvements in the tax increment Project #88-15 that assisted him during the first expansion of his facilities. Staff reviewed our files and the plans at Hakanson Anderson Associates, Inc., and we are satisfied that the City contribution toward site improvements covered only the cost of installing the storm sewer from catch basin to street. There was no indication in our correspondence files, contract documents and technical specifications, or plans that there was ever an intent that the tax increment district would pay for the installation (i.e.: trunk and lateral charges) for water and sanitary sewer. Mr. Noard's attorney has stated that Mr. Noard would settle for $15,000 cash, This offer represents approximately a 24% discount from the original $19,574.83. Motion by Councilmember Beyer and seconded by Councilmember Beahen to counter the offer. Given the uncertainty of excess increments or property taxes ever being available, a 50% discount it more appropriate. Further, any settlement should not be in cash but instead be noted as a credit against future City services. A letter of apology should also be written to Mr. Noard. Motion carded.
