Case #2: <br /> <br />Adopt Ordinance to Rezone Certain Property from B-1 Business to <br />R-1 Rural Residential; Case of C. Thomas Austin <br /> <br />Zoning Administrator Frolik reminded Council that on August 13, 1996, they adopted findings of <br />fact and introduced an ordinance to rezone the Tom Austin parcel from B-1 Business to R-1 Rural <br />Residential in order that he may resume a residential use of the property in a newly constructed <br />home. This ordinance is being presented for formal adoption. <br /> <br />Motion by Councilmember Beahen and seconded by Councilmember Zimmerman to adopt <br />Ordinance //96-15 rezoning certain property in Section 19 from B-1 Business to R-1 Rural <br />Residential. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Motion carried. <br /> <br />Councilmember Beahen aye <br />Councilmember Zimmerman aye <br />Mayor Hardin aye <br />Councilmember Beyer aye <br />Councilmember Peterson absent <br /> <br />Case 03: Request for a Conditional Use Permit for an Oversized Metal <br /> Accessory Building on Less Than 2.5 Acres; Case of Brian <br /> Wetterlind <br /> <br />Zoning Administrator Frolik explained that on July 15, 1996, the City received an application from <br />Brian Wetterlind for a conditional use permit to construct an oversized metal accessory building on <br />less than 2.5 acres on his property at 16171 Llama Street NW. City Code establishes a threshold <br />of 2.5 acres in order for residential property owners to have the metal pole barn type accessory <br />structure. Parcels less than 2.5 acres in size are restricted to a total of 1,664 square feet of garage <br />and accessory building space. Mr. Wetterlind's property is 2.4 acres is size and he is requesting <br />permission to construct a 1,350 square foot metal accessory building on the site that will bring his <br />total garage and accessory building space to 2,098 square feet. The parcels adjacent to Mr. <br />Wettedind to the west, north and east are at least 2.5 acres in size. They qualify for metal <br />accessory buildings and their garage and accessory building space allotments range from 2,664 <br />square feet to 5,664 square feet. She continued that Mr. Wetterlind's site is located in a heavily <br />forested area and the proposed location of the structure would be well screened from neighboring <br />properties and the road. The Planning Commission conducted the public heating and there were <br />no comments submitted at the hearing. The applicant did provide the City with copies of letters of <br />support from three neighboring property owners. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to adopt <br />Resolution//96-08-204 adopting Findings of Fact/g)407 relating to Brian Wetterlind's request for <br />a conditional use permit for an oversized accessory structure. <br /> <br />Motion carded. Voting Yes: Mayor Hardin, Councilmembers Zimmerman, Beyer and Beahen. <br />Voting No: None. Absent: CouncilmemberPeterson. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to adopt <br />Resolution g96-08-205 approving Mr. Wetterlind's request for a conditional use permit and declare <br />terms of same. <br /> <br />City Council/August 27, 1996 <br /> Page 8 of 17 <br /> <br /> <br />
