The public heating closed at 7:14 p.m. <br /> <br />Council Busiqess <br /> <br />Mayor Hardin called the regular portion of the City Council meeting back to order at 7:15 p.m. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Peterson to adopt Resolution <br />g96-12-340 approving the proposed modification of the Development Program for Development <br />District No. 1 and the Tax Increment Financing Plan for Tax Increment Financing District No. 7. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Beyer, Peterson, Beahen and <br />Zimmerman. Voting No: None. <br /> <br />Case #5: Implementation of Chapter 8 of the Charter <br /> <br />City Administrator Schroeder stated that this case was advertised as a public heating. He handed <br />out a resolution establishing availability charges. Based upon passage of the Charter, City Council <br />needs to determine how to implement specifics of how to recover fees from properties receiving the <br />availability of City utilities, but have not connected to them, or paid an assessment and connection <br />fees as a result of Chapter 8 of the Charter. Some of the questions that came up at the last meeting <br />were as follows: what happens when the property sells, what happens to the notice of pending <br />assessment, how do we deal with repair of septic systems. The resolution deals with a proposal <br />for access charges. <br /> <br />Mayor Hardin closed the regular portion of the City Council meeting at 7:17 p.m. in order to <br />conduct the public hearing. <br /> <br />Public Hearin~ <br /> <br />Mayor Hardin called the public heating to order at 7:17 p.m. <br /> <br />Citizen Input <br /> <br />Ben Deemer, 14501 Sunfish Lake Boulevard NW, Ramsey, stated he has not been asked for <br />advice on this ordinance, as a Planning Commissioner. He stated that the Ramsey Residents for <br />Responsible Government (RR for RG) sent out flyers lying about him (Deemer). They have stated <br />consistently for the last year that he campaigned against the charter amendment. He did not believe <br />it was done by the proper procedure, but he did not necessarily campaign against the amendment. <br />The RR for RG have said that he (Deemer) wants to take away the citizens rights according to the <br />Charter amendment. It should be made clear that he (Deemer) had nothing to do with this. No one <br />who lives outside the MUSA is offered any protection from this amendment. There's another <br />provision that protects you. If you do not live in the MUSA and you asked for sewer, 80% of the <br />registered voters would have to vote on that. That would not make it happen - that would only <br />make it possible. There are only three people in the entire City who benefit from this amendment. <br />This amendment was drawn up in November 1995 - knowing that the construction season was <br />over and this would alleviate their part, because of the retroactivity. <br /> <br />A1 Kempf, 15220 Sunfish Lake Boulevard NW, Ramsey, stated he did not know a lot about this <br />ordinance but for the threat of a $64/quarter assessment. He read from a prepared statement, <br />which is enclosed with these minutes as Exhibit "A". <br /> <br />In response to some of Mr. Kempf's concerns, Mr. Jankowski assured him that the restoration of <br />property at the corner will be replaced. The contractor is still responsible for re-seeding the turf. <br />He stated he will look at this situation and put in erosion control. <br /> <br />City Council/December 10, 1996 <br /> Page 7 of 25 <br /> <br /> <br />
