Councilmember LeTourneau introduced the following resolution and moved for its adoption: <br />RESOLUTION #13 -11 -196 <br />RESOLUTION GRANTING REQUEST FROM SOPHIA - RAMSEY, LLC FOR <br />RELEASE FROM ALLOCATION AGREEMENT ON LOTS 1 AND 2, BLOCK 1, <br />RAMSEY TOWN CENTER 3" ADDITION. <br />WHEREAS, on September 17, 2003, the City entered into a master development <br />agreement (the "Master Development Agreement" with Ramsey Town Center, LLC; and <br />WHEREAS, on February 28, 2005 the City approved the First Amendment to the City <br />of Ramsey Master Development Agreement for Ramsey Town Center (the "First Amendment "); <br />and <br />WHEREAS, on December 22, 2004, the City entered into an allocation agreement (the <br />"Allocation Agreement ") with Ramsey Town Center, LLC and RAMDANCE, LLC related to <br />allocation of improvements, sureties, assessments, and other obligations related to the plat <br />entitled Ramsey Town Center Addition (the "Plat ") and the Master Development Agreement; <br />and <br />WHEREAS, on June 25, 2009 the City approved the Termination of Master <br />Development Agreement and Parkland and Trail Plain Agreement; and <br />WHEREAS, the required improvements, sureties, and other obligations as required by <br />the Agreement have been completed. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) That the City Council hereby certifies that the City has no outstanding assessments that <br />have been levied against the Property pursuant to the Allocation Agreement; and <br />2) That the City Council hereby certifies that the Property is not otherwise encumbered by <br />any outstanding obligations owed to the City pursuant to the Allocation Agreement; <br />and <br />3) That the City no longer has the authority to levy assessments against the Property <br />pursuant to the Allocation Agreement as the Master Development Agreement has <br />been terminated. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Kuzma, and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Strommen <br />Councilmember LeTourneau <br />Councilmember Kuzma <br />
