Councilmember Backous introduced the following resolution and moved for its adoption: RESOLUTION #14-02-037 RESOLUTION APPROVING A REVISED DEVELOPMENT AGREEMENT FOR th BROOKFIELD 4 ADDITION WHEREAS, Capstone Homes, Inc., hereafter referred to as “Developer”, properly applied for major plat approval of the following described property located in the City of Ramsey: RD Outlot A, BROOKFIELD 3 ADDITION, Anoka County, Minnesota (the ‘Subject Property’); WHEREAS, on September 3, 2013, the City of Ramsey received an application and preliminary plat plans for Brookfield 4th Addition from Capstone Homes; and th WHEREAS , the Brookfield 4 Addition is a continuation of the Brookfield Addition; and WHEREAS, on October 3, 2013, the Ramsey Planning Commission conducted a public hearing regarding the proposed preliminary plat; and WHEREAS, the Ramsey Park and Recreation Commission reviewed the preliminary plat on October 10, 2013, and recommended that park dedication be satisfied with a cash payment; and WHEREAS , on October 22, 2013, the City Council approved the preliminary plat with conditions; and WHEREAS , on November 4, 2013, the Developer submitted an application for final plat; and WHEREAS , on December 10, 2013, the City Council approved the final plat; and WHEREAS , the Developer has requested an amendment to the approved Development Agreement to assign the Agreement to Brookfield Land, LLC and revised the amount of the required financial surety related to required Stage I Improvements. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That the Ramsey City Council hereby approves a revised Development Agreement for th Brookfield 4 Addition to assign the Agreement to Brookfield Land, LLC and revised the amount of the required financial surety related to required Stage I Improvements.
