J\ <br />JUN 2 4 2016 <br />111111111111111111111111111111101111 <br />Record ID 3891936 <br />Commissioner Van Scoy introduced the following resolution and moved for its adoption: <br />RESOLUTION #16-04-064 <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO CUL-DE-SAC <br />LENGTH IN THE PROPOSED PLAT OF WOODLANDS 2ND ADDITION AND <br />DECLARING TERMS OF SAME. <br />WHEREAS, U.S. Home Corporation, dba Lennar (Permittee), has properly applied for a <br />variance from the maximum cul-de-sac length prescribed in Section 117-614, Subd. (c)(3) on <br />portions of the property legally described as follows: <br />Outlot C and Outlot A, Woodlands, Anoka County, Minnesota <br />(the "Subject Property"); and <br />WHEREAS, the Planning Commission met on April 7, 2016, conducted the public hearing <br />and adopted Findings of Fact #0961 relating to the request for a variance from the maximum cul- <br />de-sac length on the Subject Property. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF <br />THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows <br />1. Based on Findings of Fact #0961, a variance to the 600-foot cul-de-sac length, as <br />established in Section 117-614, Subd. (c)(3) of the Ramsey City Code, is hereby granted <br />for the Subject Property. <br />2. The variance allows for a cul-de-sac to be constructed to an approximate length of 1300 <br />feet. <br />3. That the Permittee shall not be required to construct the bulb of the cul-de-sac if the <br />condition triggering the variance is eliminated within twelve (12) months of the recording <br />of the Final Plat of Woodlands 2nd Addition, and commencement of construction on that <br />next phase would be considered as eliminating the condition, or upon approval of the City <br />Council for an extension of time. <br />4. No construction of any building shall commence without the issuance of a building permit. <br />3. The Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this variance. <br />The motion for the adoption of the foregoing resolution was duly seconded by Commissioner <br />Andrusko, and upon vote being taken thereon, the following voted in favor thereof: <br />Vice Chairperson Bauer <br />Commissioner Van Scoy <br />Commissioner Andrusko <br />Commissioner Brauer <br />539543.002 <br />
