Councihnember Pearson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04~09-302 <br /> <br />A RESOLUTION APPROVING A REQUEST FROM BRIAN AND LAUREL JONES <br />FOR A ONE YEAR EXTENSION TO INITIATE THE VARIANCE TO THE <br />STRUCTURE SETBACK IN THE ROGERS LAKE SHORELAND OVERLAY <br />DISTRICT. <br /> <br /> WHEREAS, Brian and Laurel Jones, hereinafter referred to as "Applicants", are <br />requesting a one-year extension to initiate their variance from the minimum structure setback in <br />the Rogers Lake Shoreland Overlay District on the property legally described as follows: <br /> <br />Lot 1, Block 1, L.P. Keillor Addition, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br /> WHEREAS, on November 7, 2002, the Ramsey Board of Adjustment granted a variance <br />to the minimum structure setback requirements in the Rogers Lake Shoreland Overlay District; <br />and <br /> <br /> WHEREAS, Section 9.03.07 (Variances), Subd. 4 (Lapse of Variance) of the Ramsey <br />City Code states that unless otherwise specified, a variance shall become null and void one year <br />after final action by the Board of Adjustment if not initiated or utilized; and <br /> <br /> WHEREAS, the variance granted to the Applicants specified a two year time frame in <br />which to initiate the variance or until November 7, 2004; and <br /> <br /> WHEREAS, Section 9.03.07 (Variance), Subd. 4 (Lapse of Variance) of the Ramsey <br />City Code further states that the applicant may request the City Council to grant an extension of <br />time to complete or utilize the variance; and <br /> <br /> WHEREAS, on September 14, 2004, the City received a written communication from <br />the Applicants requesting a one-year extension to utilize their variance granted on November 7, <br />2004. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the City Council hereby grants a one year extension ending on November 7, 2005, <br />for the Applicantss to initiate the variance to the minimum structure setback in the Rogers <br />Lake Shoreland Overlay District <br /> <br /> <br />
