Board Member Johnson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04-09-236 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0696 RELATING TO A REQUEST <br />FOR A VARIANCE TO EXPAND A LAWFUL NONCONFORMING ACCESSORY <br />STRUCTURE WHICH IS NEARER THE FRONT PROPERTY LINE THAN THE <br />HOME. <br /> <br /> WHEREAS, Michael Mettler, hereinafter referred to as "Applicant," has properly <br />applied for a variance from Section 9.03.14 (Non-conforming Structures and Uses) and Section <br />9.11.02 (Accessory Structures) of the Ramsey City Code to construct an addition on an existing <br />accessory structure that is located nearer the front property line than the home on a property less <br />than two (2) acres in size on the property generally known as 15315 Sunfish Lake Blvd NW and <br />legally described as follows: <br /> <br />The south 194.5 feet of that part of the Southwest Quarter of the Northwest Quarter <br />of Section 23, Township 32, Range 25, Anoka County, Minnesota lying easterly of <br />the ccnterline of County State Aid Highway Number 57. Excluding road and subject <br />to easements of record. <br /> <br />(Subject Property) <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSE¥, ANOKA COUNTY~ STATE OF MINNESOTA, as follows: <br /> <br />That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.07 of the <br />Ramsey City Code on September 2, :2004, and that said public hearing was properly <br />advertised, and that the minutes of said public hearing are hereby incorporated as a part of <br />these findings by reference. <br /> <br />2. That the Applicant owns two adjoining lots and submitted a lot combination request to <br /> Anoka County on May 6, 2004. <br /> <br />3. That the Subject Property is zoned R-1 MUSA and is approximately 1.73 acres in size. <br /> <br />That the Subject Property is adjacent to properties zoned R-1 MUSA on the north and south, <br />R-1 Rural Developing to the west (across Sunfish Lake Blvd), and R-2 Medium Density to <br />the east. <br /> <br />5. That a building permit was issued in 1974 for a detached garage, which is 660 square feet in <br /> size, that is nearer the front property line than the principal structure. <br /> <br />That Section 9.11.02 (Accessory Structures) of the Ramsey City Code now states that on <br />properties less than two (2) acres in size, accessory buildings shall be located in the side or <br />rear yard and shall not be located nearer the front property line than the principal building on <br />that lot unless a variance is obtained. <br /> <br /> <br />
