Councilmember Kuzma introduced the following resolution and moved for its adoption: RESOLUTION #19-026 RESOLUTION APPROVING AN ENCROACHMENT AGREEMENT FOR A DETACHED ACCESSORY BUILDING TO BE LOCATED IN A DRAINAGE AND UTILITY EASEMENT ON THE PROPERTY GENERALLY KNOWN AS 15261 BARIUM ST NW AND DECLARING TERMS OF SAME WHEREAS, Alan and Susan Gustafson, hereinafter referred to as the "Applicant," have requested an Encroachment Agreement to allow a 10' x 20' shed (the "Shed") to be located in a drainage and utility easement (the "Easement") on the property legally described as follows: Lot 1, Block 3, WILLOW RIDGE, Anoka County, Minnesota (the "Subject Property"). WHEREAS, the Applicant has supplied the City of Ramsey a topographic survey, completed by a licensed surveyor, that has been utilized to update the stormwater model for this area; and WHEREAS, the Engineering Department has found that the Easement can still function with the encroachment of the Shed; and WHEREAS, City Council reviewed the Encroachment Agreement request on January 22, 2019; and WHEREAS, the Applicant must obtain a Zoning Permit prior to constructing/installing the Shed on the Subject Property. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. That, contingent upon the Applicant entering into an Encroachment Agreement with the City and recording said agreement against the Subject Property, the Applicant may construct and maintain the Shed in accordance with the terms and conditions contained within the Encroachment Agreement. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Shryock, and upon vote being taken thereon, the following voted in favor thereof: Mayor LeTourneau Councilmember Kuzma Councilmember Shryock Councilmember Heinrich Councilmember Musgrove
