Record ID 1544118 482309.007 Councilmember Kurak introduced the following resolution and moved for its adoption: RESOLUTION #04-07-193 A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO RAMDANCE LLC TO OPERATE A DRIVE-THRU FOR PHARMACY OPERATIONS AS PART OF A PROPOSED GROCERY STORE IN THE TC-2 ZONING DISTRICT AND DECLARING TERMS OF SAME: WHEREAS, Ramdance LLC, hereinafter referred to as the "Applicant," has properly applied lbr a Conditional Use Permit to operate a drive-thru for pharmacy operations as part of a proposed grocery store in the TC-2 Zoning District on property legally desCribed as follows: Outlot I, Ramsey Town Center Addition, Anoka County, Minnesota ("Subject Property") WHEREAS, the Planning Commission met on July 12, 2004, conducted the public hearing and recommended City Council approval of the request. NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: t. Based on Findings of Fact #0686, a Conditional Use Permit (Permit) to operate a drive-thru for pharmacy operations as part of a proposed grocery store in the TC-2 Zoning District, is hereby granted to Ramdance, LLC, hereinafter referred to as the "Permittee". T}t~lt the Permit only applies to the drive-thru that will be part of the grocery store to be lo,zated in the future Lot 1, Block 1 of Ramsey Town Center 3rd Addition. That the Permit only allows for the use of the drive-thru to support pharmacy operations contained within the proposed grocery store. 4. That the area of the drive-thru shall only be located as shown on the proposed site plan for thc grocery store. Any relocation of the drive-thru shall be reviewed and approved by the City (;ouncil. .5. That thc area utilized for the drive-thru shall be properly constructed and maintained in accordance with all applicable Staff Review letters, approved site plans, City Code, and [lnifhrm Building Codes.
