Mayor Gamec introduced the following resolution and moved for its <br />adopti on: <br /> <br />RESOLUTION #84-109 <br /> <br /> WHEREAS, the Council has received a proposed contract <br />for the sale of the City's interest in the existing landfill site <br />and eighty (80) acres immediately South and adjacent thereto, <br />which property is legally described as follows: <br /> <br />The South one-half (S 1/2) of the Southeast one-quarter <br />(SE 1/4) of Section 22, Township 32, Range 25, Anoka <br />County, Minnesota, <br /> <br />The North one-half (N 1/2) of the Northeast one-quarter <br />(NE 1/4) of Section 27, Township 32, Range 25, ,Anoka <br />County, Minnesota; <br /> <br /> AND WHEREAS, the Council has held several executive <br />sessions to discuss this subject in conjunction with the Ramsey <br />vs. Anoka landfill suit; and <br /> <br /> WHEREAS, the Council has reviewed numerous drafts of a <br />proposed contract, which contract has been discussed and <br />negotiated by the City's Mayor and City Attorney pursuant to <br />Council direction; and <br /> <br /> WHEREAS, the Council finds that its retention of an <br />interest in the above-described property is not necessary for the <br />City's purposes and that to sell the City's interest is in the <br />City's best interests; and <br /> <br /> WHEREAS, the contract addresses the issue of liability <br />relating to the existing landfill and provides for <br />indemnification for the City of Ramsey; and <br /> <br /> WHEREAS, the consideration as described in the contract <br />for the sale of the City's interest appears adequate; and <br /> <br /> WHEREAS, by the execution of this contract the City <br />does not commit itself to the placing of an additional landfill <br />site in the City. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA (JOUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> 1) That the Mayor and City Administrator are <br />authorized to sign in behalf of the City the contract as <br />presented. <br /> <br /> <br />
