The permit shall terminate on June 30, 2006. <br />RESOLUTION #01 - 06 - 237 <br />A RESOLUTION APPROVING THE ISSUANCE OF AN INTERIM USE PERMIT FOR <br />THE ESTABLISHMENT OF AN OUTDOOR PAINTBALL RECREATIONAL <br />FACILITY LOCATED IN AN INDUSTRIAL AREA BASED UPON FINDINGS OF <br />FACT #0560 AND DECLARING TERMS OF SAME. <br />WHEREAS, Brian Gower, dba Diehard Paintball, (Permittee) has properly applied for <br />an interim use permit to establish an outdoor paintball course on the property generally know as <br />14622 Ferret Street and legally described as follows: <br />Lot 2, Block 1 Hy -10 Ramsey, together with that part of the Southwest Quarter of <br />the Northeast Quarter of Section 29, Township 32, Range 25, Anoka County, <br />Minnesota, lying northeasterly of the northeasterly line of the Burlington Northern <br />Railroad. <br />WHEREAS, the Planning Commission met on June 5, 2001, conducted a public hearing <br />and recommended City Council approval of the request. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. Based on Findings of Fact #237, an Interim Use Permit ( "Permit ") to establish an outdoor <br />paintball course in an Industrial area on the Subject Property is hereby granted to the <br />Permittee. <br />3. Operating hours of the Paintball course shall be limited to Monday through Friday, 10:00 <br />a.m. — 10:00 p.m., Saturday 8:00 a.m. — 10:00 p.m. and Sunday 12:00 p.m. — 10:00 p.m. <br />4. The Permittee shall not construct any permanent structures without the prior approval of the <br />City. <br />5. The Permittee shall obtain $1,000,000.00 public liability insurance policy the form of which <br />shall be approved by the City and which policy shall be in place during the term of this <br />Interim Permit. <br />6. The Permittee shall provide off - street parking on the existing parking lot of the Subject <br />Properly and shall prohibit any parking along public streets. <br />7. The City, in its discretion, may review the paintball use in the event it receives frequent <br />complaints, including noise levels, as a result of the use. This review procedure shall be the <br />same as the conditional use permit revocation procedure of Chapter 9 of the City Code. <br />Excessive noise complaints shall be cause for revocation of the paintball use. <br />8. The City reserves the right to revoke the paintball use in the event it finds the use is either <br />harmful to the public health and welfare and /or the quiet enjoyment and use of neighboring <br />
