Councilmember Cook introduced the following resolution and moved for its adoption: <br /> RESOLUTION #06-08-270 <br /> A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br /> TO HTG ARCHITECTS TO OPERATE A DRIVE-THRU FOR BANK OPERATIONS IN <br /> THE TC-2 ZONING DISTRICT AND DECLARING TERMS OF SAME: <br /> WHEREAS, Shingobee Builders, Inc, hereinafter referred to as the "Applicant," has <br /> properly applied for a Conditional Use Permit to operate a drive-thru for Klein Bank in the TC-2 <br /> Zoning District on property legally described as follows: <br /> Outlot H, Ramsey Town Center Addition, Anoka County, Minnesota <br /> -or upon recording- <br /> Lot 1, Block 1, Ramsey Town Center 14th Addition <br /> ("Subject Property") <br /> WHEREAS, the Planning Commission met on August 3, 2006 conducted the <br /> public hearing and recommended City Council approval of the request, with contingencies. <br /> NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br /> CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> 1. Based on Findings of Fact #0776, a Conditional Use Permit (Permit) to operate a drive-thru <br /> for Klein Bank in the TC-2 Zoning District is hereby granted to Shingobee Builders, Inc, <br /> referred to as the "Permittee". <br /> 2. That the Permit only applies to the drive-thru that will be part of Klein Bank to be located in <br /> the future Lot 1, Block 1 of Ramsey Town Center 14th Addition. <br /> 3. That the proposed drive-thru shall be constructed as indicated on the associated site plan <br /> approved in accordance with this permit. Any relocation of the drive-thru shall be reviewed <br /> and approved by the City Council. <br /> 4. That the area utilized for the drive-thru shall be properly constructed and maintained in <br /> accordance with all applicable Staff Review letters, approved site plans, City Code, and <br /> Uniform Building Codes. <br /> 5. That the landscaping and fencing contingencies, as outlined in the site plan city review letter <br /> dated July 28, 2006 shall be installed and maintained as long as this permit is valid. <br /> 6. That this Permit shall be perpetual in duration as long as the terms are herein complied with. <br />
