Councilmember Peterson introduced the following resolution and moved for its adoption: RESOLUTION #92-04-057 RESOLUTION AUTHORIZING RELEASE OF DRAINAGE AND UTILITY EASEMENT IN SIBBEL ADDITION WHEREAS, by Quit Claim Deed dated May 24, 1983, the City acquired a perpetual easement for storm drainage purposes over, under and across the following described property: The East 20 feet of the West 930 feet of the North 213 feet of the South 263 feet of the Northeast Quarter of the Northeast Quarter of Section 21, Township 32, Range 25, Anoka County, Minnesota (the "Easement"). AND WHEREAS, the May 24, 1983 Quit Claim Deed states that the property owner may require the City to relocate the easement in the event it is necessary to relocate the same upon future development of the land owner's property; and WHEREAS, Sibbel Addition is a plat which contains the easement and which plat required the relocation of the easement; and WHEREAS, the City Engineer has required easements in the Sibbel Addition which will serve as an alternative to the Easement. NOW TIIEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the Mayor and City Administrator are hereby authorized and directed to sign the appropriate recordable document releasing the City's interest in the Easement. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Beyer and upon vote being taken thereon, the following voted in favor thereof: Mayor Gilbertson Councihnember Peterson Councilmember Beyer Councilmember Hardin Councilmember Zimmerman and the following voted against the same: None and the following abstained: None and the following were absent: None whereupon said resolution was declared duly passed and adopted by the City Council this 14th day of April, 1992.
