Councilmember Peterson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #92-04-057 <br /> <br />RESOLUTION AUTHORIZING RELEASE OF DRAINAGE AND UTILITY EASEMENT IN <br />SIBBEL ADDITION <br /> <br /> WHEREAS, by Quit Claim Deed dated May 24, 1983, the City acquired a perpetual easement for <br />storm drainage purposes over, under and across the following described property: <br /> <br />The East 20 feet of the West 930 feet of the North 213 feet of the South 263 feet of the <br />Northeast Quarter of the Northeast Quarter of Section 21, Township 32, Range 25, Anoka <br />County, Minnesota (the "Easement"). <br /> <br /> AND WHEREAS, the May 24, 1983 Quit Claim Deed states that the property owner may require <br />the City to relocate the easement in the event it is necessary to relocate the same upon future development of <br />the land owner's property; and <br /> <br /> WHEREAS, Sibbel Addition is a plat which contains the easement and which plat required the <br />relocation of the easement; and <br /> <br /> WHEREAS, the City Engineer has required easements in the Sibbel Addition which will serve as an <br />alternative to the Easement. <br /> <br />NOW TIIEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the Mayor and City Administrator are hereby authorized and directed to sign the appropriate <br />recordable document releasing the City's interest in the Easement. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Beyer and <br />upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gilbertson <br />Councihnember Peterson <br />Councilmember Beyer <br />Councilmember Hardin <br />Councilmember Zimmerman <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br />and the following were absent: <br /> <br />None <br /> <br />whereupon said resolution was declared duly passed and adopted by the City Council this 14th day of April, <br /> <br />1992. <br /> <br /> <br />
