Bawden introduced the following resolution and moved for its adoption: RESOLUTION g93-06-100A A RESQLUTION ADOPTING FINDINGS OF FACT 6'0335 RELATING TO A REQUEST FOR A VARIANCE TO SIDE YARD SETBACK REQUIREMENTS ON PARCELS IN THE PLAT OF AMBER RIDGE WF~EREAS, Gor-em, LLC, hereinafter referred to as "Applicant", has properly applied for a Boardiof Adjustment variance fi.om Section 9.20.12 of the Ramsey City Code to construct homes withes s~e yard setback of six (6) feet versus ten (10) feet on the garage side of the parcels on the prop~ legally described as follows: AMBER RIDGE, Anoka County, State of Minnesota. Now THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUST1V~EN~ OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. Thatithe Applicant appeared before the Board of Adjustment for a public hearing pursuant to Segfion 9.03.05 of the Ramsey City Code on June 7, 1993 and that said public hearing was ,~operly advertised and that the minutes of said public hearing are hereby incorporated as a part of these £mdings by reference. 2. That the subject pan:els within the plat of Amber Ridge are zoned R- 1 Urban Residential. 3. That Beetion 9.20.12 of the Ramsey City Code establishes a structure setback of ten (10) feet'i~om side property lines. 4. That the Applicant has stated that the current market mend is for homes designed with triple attached garages. 5. That the Applicant has provided the City with information that indicates the footprint width of homes'.with triple garages ranges from 62'8" to 64'. 6. That ~e standard lot width in the urban area is eighty (80) feet. 7. That the home footprint plus twenty (20) feet for two 10-foot side yards exceeds the standard m'ban lot width in the City. 8, That ¢ityiStaff has surveyed surrounding communities and it has been deterrnjned that a majority of the communities require a five (5) to six (6) foot side yard setback on the garage side of the property, 9. That the special conditions causing the undue hardship do not result from the actions of the Appli~ant'as the Applicant is not responsible forsetting the market trend. 10. That When the Applicant approached the Ramsey City Council on May 25, 1993 regarding side y~d setbacks and their impact on the architectural aesthetics of the home, the City Counffll directed the Planning and Zoning Commission to initiate action to amend City Code t0 reduce the side yard setback in the urban area to six (6) feet on the garage side. In the irt~rim, the City Council instructed the Ramsey Board of Adjustment to conduct a speeia! mOer ting and consider granting a variance to the garage side yard setbacks in Amber Ridge So aa not to delay development of that subdivision.
