Councilmember Zimmerman introduced the following resolution and moved for its adoption: RESOLUTION g94-02-043 RESOLUTION AUTHORIZING ACQUISITION OF CERTAIN PERMANENT STREET AND UTILITY EASEMENT BY USE OF MSA §117.011 AND §117.042 WHIgREAS, the City of Ramsey (the "City") has constructed an interceptor sewer main improvement known as Improvement Project #87-19, which improvement consisted of a sanitary sewer interceptor pipe line to serve properties in the City and was necessary for the safety and convenience of the residents of the City; and WHEREAS, the City has constructed sanitary sewer and water main improvements known as Iraprovement Project g91-01, which improvements consisted of sanitary sewer and water mains to serve properties in the City which are necessary for the safety and convenience of the residents of the City; and WHEREAS, permanent utility easements are required over, under and across the property where said improvements have been constructed; and WHEREAS, the alignment of the existing interceptor sewer main (Improvement Project #87-19) is coincident with the route for the future extension of McKinley Street; and WHEREAS, the City finds it necessary to acquire right-of-way for the McKinley Street extension; and WHE~REAS, the City has the authority to acquire easements for said utilities by eminent domain pursuant to Minnesota Statutes § 117; and WHEREAS, the property owners from whom easements are required have been identified by the City as follows: PIN FEE OWNER EASEMENT DESCRIPTION 35-32-25-21-0001 Leonard J. Spohn Lois J. Spohn An 80.00 foot perpetual easement for street and utility purposes, the centerline of which is described as follows, to-wit: Beginning at the intersection of the west line of the east 10 rods of the Northwest Quarter of Section 35, Township 32, Range 25, Anoka County, Minnesota, and a line 390.00 feet northeasterly of as measured at a right angle to and parallel with the northerly right-of- way of the Burlington Northern Railroad; thence northwesterly parallel with said northerly right-of-way to the east line of Outlot A, RAMSEY 67 INDUSTRIAL PARK FIRST ADDITION, Anoka County, Minnesota and said centerline there terminating. The northerly and southerly lines of said easement are to be prolonged or shortened to terminate on the west line of the east 10 rods of said Northwest Quarter and the east line of said Outlot.
