Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION g94-02-043 <br /> <br />RESOLUTION AUTHORIZING ACQUISITION OF CERTAIN PERMANENT <br />STREET AND UTILITY EASEMENT BY USE OF MSA §117.011 AND §117.042 <br /> <br /> WHIgREAS, the City of Ramsey (the "City") has constructed an interceptor sewer main <br />improvement known as Improvement Project #87-19, which improvement consisted of a sanitary <br />sewer interceptor pipe line to serve properties in the City and was necessary for the safety and <br />convenience of the residents of the City; and <br /> <br /> WHEREAS, the City has constructed sanitary sewer and water main improvements <br />known as Iraprovement Project g91-01, which improvements consisted of sanitary sewer and <br />water mains to serve properties in the City which are necessary for the safety and convenience of <br />the residents of the City; and <br /> <br /> WHEREAS, permanent utility easements are required over, under and across the <br />property where said improvements have been constructed; and <br /> <br /> WHEREAS, the alignment of the existing interceptor sewer main (Improvement Project <br />#87-19) is coincident with the route for the future extension of McKinley Street; and <br /> <br /> WHEREAS, the City finds it necessary to acquire right-of-way for the McKinley Street <br />extension; and <br /> <br /> WHE~REAS, the City has the authority to acquire easements for said utilities by eminent <br />domain pursuant to Minnesota Statutes § 117; and <br /> <br /> WHEREAS, the property owners from whom easements are required have been <br />identified by the City as follows: <br /> <br />PIN <br /> <br />FEE OWNER EASEMENT DESCRIPTION <br /> <br />35-32-25-21-0001 <br /> <br />Leonard J. Spohn <br />Lois J. Spohn <br /> <br />An 80.00 foot perpetual easement for street and utility <br />purposes, the centerline of which is described as <br />follows, to-wit: <br /> <br />Beginning at the intersection of the west line of the <br />east 10 rods of the Northwest Quarter of Section 35, <br />Township 32, Range 25, Anoka County, Minnesota, <br />and a line 390.00 feet northeasterly of as measured at <br />a right angle to and parallel with the northerly right-of- <br />way of the Burlington Northern Railroad; thence <br />northwesterly parallel with said northerly right-of-way <br />to the east line of Outlot A, RAMSEY 67 <br />INDUSTRIAL PARK FIRST ADDITION, Anoka <br />County, Minnesota and said centerline there <br />terminating.
