Board Member LaDue introduced the following resolution and moved for its adoption: RESOLUTION #94-03-050 A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND DECLARING TERMS OF SAME WHEREAS, Terry Hendriksen has properly applied for a variance to construct an addition to the principal structure that will encroach on the C.S.A.H. #56 thoroughfare setback on the property generally known as 15631 Ramsey Blvd. N.W. and legally described as follows: That part of the North Three Quarters of North Half of Northwest Quarter of Northwest Quarter of Section 22, Township 32, Range 25, Anoka County, Minnesota, described as follows: Commencing at a point on the West line of said Northwest Quarter of Northwest Quarter, distant 165 feet South of the Northwest corner thereof; thence East and parallel to the North line of said Northwest Quarter of Northwest Quarter, a distance of 659.3 feet; thence South at right angles a distance of 165 feet; thence East parallel to the North line of said Northwest Quarter of Northwest Quarter, a distance of 659.3 feet, more or less, to the East line of said Northwest Quarter of Northwest Quarter, thence South along said East line a distance of 165 feet, more or less, to the South line of the North Three Quarters of North Half of said Northwest Quarter of Northwest Quarter, thence West along said South line to a point on the West line of said Northwest Quarter of Northwest Quarter, distant 496.38 feet South of the Northwest corner thereof; thence North along 'said West line to the point of beginning. WHEREAS, the Board of Adjustment met on March 17, 1994, conducted the public hearing and adopted findings of fact relating to the request to encroach on the 110 foot thoroughfare setback for C.S.A.H. #56. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: Based on Findings of Fact #0355, a variance to construct an addition to the principal structure that will encroach on the C.S.A.H. #56 thoroughfare setback is hereby granted. The addition to the principal structure shall maintain a minimum distance of eighty-five (85) feet from the centerline of C.S.A.H. #56. o That any requirement for a certificate of survey is hereby waived by reason that the proposed construction will be attached to the existing principal structure which is in conformance with side and rear yard setbacks. 4. This variance shall not apply to any future structure(s) placed on the property. o The property owner shall obtain all necessary permits prior to commencing any construction. The property owner shall be responsible for all City costs incurred in administering and enforcing this variance.
