Board Member LaDue introduced the following resolution and moved for its adoption: <br /> <br /> RESOLUTION #94-03-050 <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND <br />DECLARING TERMS OF SAME <br /> <br /> WHEREAS, Terry Hendriksen has properly applied for a variance to construct an <br />addition to the principal structure that will encroach on the C.S.A.H. #56 thoroughfare setback on <br />the property generally known as 15631 Ramsey Blvd. N.W. and legally described as follows: <br /> <br />That part of the North Three Quarters of North Half of Northwest Quarter of <br />Northwest Quarter of Section 22, Township 32, Range 25, Anoka County, <br />Minnesota, described as follows: Commencing at a point on the West line of said <br />Northwest Quarter of Northwest Quarter, distant 165 feet South of the Northwest <br />corner thereof; thence East and parallel to the North line of said Northwest Quarter <br />of Northwest Quarter, a distance of 659.3 feet; thence South at right angles a <br />distance of 165 feet; thence East parallel to the North line of said Northwest Quarter <br />of Northwest Quarter, a distance of 659.3 feet, more or less, to the East line of said <br />Northwest Quarter of Northwest Quarter, thence South along said East line a <br />distance of 165 feet, more or less, to the South line of the North Three Quarters of <br />North Half of said Northwest Quarter of Northwest Quarter, thence West along said <br />South line to a point on the West line of said Northwest Quarter of Northwest <br />Quarter, distant 496.38 feet South of the Northwest corner thereof; thence North <br />along 'said West line to the point of beginning. <br /> <br /> WHEREAS, the Board of Adjustment met on March 17, 1994, conducted the public <br />hearing and adopted findings of fact relating to the request to encroach on the 110 foot <br />thoroughfare setback for C.S.A.H. #56. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF <br />MINNESOTA, as follows: <br /> <br />Based on Findings of Fact #0355, a variance to construct an addition to the principal <br />structure that will encroach on the C.S.A.H. #56 thoroughfare setback is hereby granted. <br /> <br />The addition to the principal structure shall maintain a minimum distance of eighty-five (85) <br />feet from the centerline of C.S.A.H. #56. <br /> <br />o <br /> <br />That any requirement for a certificate of survey is hereby waived by reason that the <br />proposed construction will be attached to the existing principal structure which is in <br />conformance with side and rear yard setbacks. <br /> <br />4. This variance shall not apply to any future structure(s) placed on the property. <br /> <br />o <br /> <br />The property owner shall obtain all necessary permits prior to commencing any <br />construction. <br /> <br />The property owner shall be responsible for all City costs incurred in administering and <br />enforcing this variance. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Holland and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Chairperson Ben Deemer <br />Board Member Charles LaDue <br />Board Member Paul Holland <br />Board Member Michael Terry <br />Board Member Bradley Thorud <br /> <br /> <br />
