Councilmember Hendriksen introduced the following resolution and moved for its <br />adoption: <br /> <br />RESOLUTION #99-09-170 <br /> <br />RESOLUTION RESCINDING RESOLUTION #99-07-133 AND AWARDING <br />CONTRACT FOR THE PURCHASE OF COMPUTER NETWORK HARDWARE <br />AND SOFTWARE <br /> <br /> WHEREAS, on September 8, 1998, City Council authorized the bidding for <br />computer network hardware and software; and <br /> <br /> WHEREAS, the City Council authorized the Local Government Information <br />Systems Association (LOGIS) to provide bidding recommendations; and <br /> <br /> WHEREAS, the City, through LOGIS, ordered certain computer equipment <br />which was delivered to it by Inacom; and <br /> <br /> WHEREAS, after taking receipt of the computer equipment, the City obtained <br />three quotes for the equipment. The sealed bid process was not used since it was <br />anticipated that the equipment cost would not exceed $25,000.00; and <br /> <br /> WHEREAS DataSource Hagen ("DataSource") was the lowest bidder (lower <br />than Inacom Information Systems ("Inacom") by approximately $1,300.00; and <br /> <br /> WHEREAS, the City Council adopted Resolution #99-07-133, accepting the <br />lowest bid (quote) from DataSource and directing that a contract be awarded to it; and <br /> <br /> WHEREAS, the computer equipment has been delivered to the City by Inacom <br />and it is now too late, according to Inacom, to return it. In addition, software was also <br />installed in the DataSource equipment making it impossible to return and LOGIS has <br />paid Inacom; and <br /> <br /> WHEREAS, the City has not yet installed the new computer equipment and has <br />not paid Inacom; and <br /> <br /> WHEREAS, DataSource is contacting the City and wants to conclude the sale to <br />the City pursuant to Resolution #99-07-133; and <br /> <br /> WHEREAS, The City Council, at its August 24, 1999 meeting, approved the <br />payment to Inacom subject to approval of the transaction by the City Attorney; and <br /> <br /> WHEREAS, according to information stated above, the City is not able to enter <br />into a contract with DataSource Hagen and, therefore, must rescind Resolution #99-07- <br />133, which authorized awarding the bid to DataSource Hagen. <br /> <br /> <br />
