Board Member Kociscak introduced the following resolution and moved for its adoption: <br />RESOLUTION #01 -04 -171 <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND DECLARING <br />TERMS OF SAME <br />WHEREAS, Sunfish Properties, L.L.C. has properly applied for a variance from the <br />maximum impervious surface restrictions in the Critical River Overlay District and Wild and <br />Scenic Overlay District on the property legally described as follows: <br />That part of east half of Government Lot 4, Section 34, Township 32, Range 25, <br />Anoka County, Minnesota. Lying southerly of southerly right -of -way line of <br />Burlington Northern Railroad and lying northerly of northerly right -of -way line of <br />Trunk Highway #10, except that part thereof lying west of following described line: <br />Commencing at intersection of west line of said east half with southerly right -of -way line <br />of said Burlington Northern Railroad thence southeasterly along said railroad right -of- <br />way line 75.12 feet to point of beginning of said line, thence southerly 427.52 feet + or - <br />to intersection with northerly right -of -way line of said Trunk Highway #10 68.87 feet, as <br />measured along said northerly right -of -way line, southeasterly of point of intersection <br />with west line of said east half and said line there terminating, AKA part of Lot 11 <br />Auditor's Subdivision No. 30, except road, subject to easement of record. <br />(the "Subject Property"); and <br />WHEREAS, the Board of Adjustment met on April 3, 2001, conducted the public <br />hearing and adopted findings of fact relating to the request for a variance from height restrictions. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows <br />0 <br />1. Based on Findings of Fact #0548, a variance to the maximum impervious surface <br />restrictions in the Critical River and Wild and Scenic River Overlay District is hereby <br />granted in accordance with Letter from Department of Natural Resources dated April 3, <br />2001. <br />2. The developer shall not exceed impervious surface coverage of more than 69% for the <br />property contained within the Critical River and the Wild and Scenic River Overlay <br />District. <br />3. The property owner shall obtain all necessary permits prior to commencing any <br />construction. No building permit for the structures shall be released by the City of <br />Ramsey without certification of the variance by the Department of Natural Resources in <br />accordance with procedures established in Section 9.21.07 (Critical River Overlay <br />
