<br />Councilmember Stewart introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #26-160A <br /> <br />RESOLUTION APPROVING AN ONSITE WASTEWATER TREATMENT SYSTEM <br />COMPLIANCE AGREEMENT BETWEEN THE CITY OF RAMSEY AND VOICE OF <br />HOPE CHURCH FOR PROPERTY LOCATED AT 15620 ARMSTRONG BOULEVARD <br /> <br /> WHEREAS Voice of Hope Church owns property located at 15620 Armstrong <br />Boulevard NW, Ramsey, Minnesota, legally described as Lot 1, Block 1, Voice of Hope Church <br />Addition, subject to easements of record, which is served by an Onsite Wastewater Treatment <br />System (OWTS); and <br /> <br /> WHEREAS, the City of Ramsey is responsible for the administration and enforcement <br />of Minnesota Rules Chapters 7080 through 7083 and applicable City ordinances governing onsite <br />wastewater treatment systems; and <br /> <br /> WHEREAS, the septic system designer and licensed installer have determined that the <br />site does not have sufficient area to accommodate the septic tank capacity that would otherwise <br />be required utilizing the standard design flow criteria established under Minnesota Rules Chapter <br />7081.0130; and <br /> <br /> WHEREAS, the proposed Onsite Wastewater Treatment System Compliance Agreement <br />establishes procedures for monitoring water usage over a three-month period utilizing the City <br />water meter, evaluating the measured flows, requiring system improvements if necessary, and <br />requiring reevaluation of the wastewater treatment system should the use or occupancy of the <br />property change in the future <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) The Onsite Wastewater Treatment System Compliance Agreement between the City of <br />Ramsey and Voice of Hope Church for the property located at 15620 Armstrong <br />Boulevard NW is hereby approved in substantially the form presented to the City <br />Council. <br /> <br />2) The Mayor and City Administrator are authorized and directed to execute the Agreement <br />on behalf of the City of Ramsey. <br /> <br />3) City staff are authorized to administer and enforce the terms of the Agreement, including <br />review of the flow monitoring data, determination of compliance, and implementation of <br />any actions required under the Agreement and applicable Minnesota Rules. <br /> <br />4) Voice of Hope is required to record the agreement at the Anoka County Office of <br />Recorders/Registrar of Titles. <br /> <br /> <br />
