Subsequent to the platting of Reilley Estates, in 1981 the City adopted the Scenic
River Ordirt~agce ~which requires a 150 foot structure setback from Ordinary High Water mark of
the river. With a40 foot front yard and a 150 foot rear yard setback, there is not sufficient area on
a one acre lot to meet both the required setbacks. He added that the Department of Natural
Resources p~'Ofers that communities grant variances to local setbacks versus river setbacks.

Mr. Ploegercommented that the garage would be built at an angle to save several mature oak trees.

The Board Of Adjustment proceeded to review the findings of fact.

Board of Adjustment/August 27, 1992
