<br />Board Member Jeffrey introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #09-01-010 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0840 RELATING TO A <br />REQUEST FOR A VARIANCE TO THE PLATTING REQUIREMENTS IN CITY CODE <br />TO ALLOW A METES AND BOUNDS SUBDIVISION <br /> <br />WHEREAS, the City of Ramsey, hereinafter referred to as "Applicant", has properly <br />applied for a variance to platting requirements (the "Variance") established in Section 9.50 <br />(Subdivision) of the Ramsey City Code to facilitate a metes and bounds subdivision for right-of- <br />way acquisition for the extension of Quicksilver Street NW in association with the access to <br />Elmcrest Park and the proposed Water Tower #3 site. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That the Applicant appeared before the Board of Appeals for a public hearing on January 13, <br />2009, and that said public hearing was properly advertised and that the minutes of said public <br />hearing are hereby incorporated as a part of these findings by reference. <br /> <br />2. That Section 9.50.07 (Subdivision) of City Code requires that any new lots be created <br />through the platting process. <br /> <br />3. That the Applicant currently has a temporary easement for access to Elmcrest Park from the <br />terminus of Quicksilver Street NW. <br /> <br />4. That the Applicant is in the process of acquiring an additional parcel to construct a <br />municipal water tower, which will require permanent access from the terminus of Quicksilver <br />Street. <br /> <br />5. That the Applicant is in the process of assembling two additional parcels near Elmcrest Park <br />for the purposes of providing land for the Quicksilver Street right-of-way and storm water <br />ponding. <br /> <br />6. That in order to provide this right-of-way to the City, a land subdivision is necessary to split <br />the existing parcels to convey the land to the City. <br /> <br />7. That two parcels will be created to facilitate future right-of-way and storm water ponding for <br />Quicksilver Street. <br /> <br />8. That the two newly created parcels will not be considered buildable until such time that <br />municipal sewer and water are available, and the remnant parcels are platted in accordance <br />with Section 9.50.07 of City Code. <br />
