<br />Councilmember McGlone introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #10-01-021 <br /> <br />RESOLUTION AUTHORIZING ACQUISITION OF FEE TITLE TO CERTAIN <br />PROPERTIES AND TEMPORARY AND PERMANENT EASEMENTS NECESSARY <br />FOR CONSTRUCTION OF THE CSAH 116 AND ARMSTRONG BOULEVARD <br />INTERSECTION IMPROVEMENTS <br /> <br />WHEREAS, the City finds it necessary and in the public interest to construct intersection <br />improvements to serve the public utility, safety, and transportation needs of the City's residents <br />and such improvements were authorized as project #06-20 by the City Council in 2005 (the <br />"Public Improvement Project"); and <br /> <br />WHEREAS, the Public Improvement Project IS identified as a transportation <br />improvement in the Ramsey Town Center AUAR; and <br /> <br />WHEREAS, the Public Improvement Project is identified in the City's Joint Powers <br />Agreement (JP A) with Anoka County dated May 12, 2005 related to regional roadway <br />improvements within the Ramsey Town Center; and <br /> <br />WHEREAS, the Public Improvement Project IS also identified as Anoka County <br />Highway project, SAP 02-683-02; and <br /> <br />WHEREAS, the City requests Anoka County to acquire the necessary properties from <br />private property owners for the construction of the Public Improvement Project; and <br /> <br />WHEREAS, the City shall reimburse Anoka County all costs incurred by the County in <br />acquiring the necessary properties, consistent with the approved JP A; and <br /> <br />WHEREAS, the necessary properties to be acquired are as shown on the Anoka County <br />Right-Of- Way Plat No. 74 attached as EXHIBIT A <br /> <br />(the "Property Interests"); and <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, AS FOLLOWS: <br /> <br />1. That in order to carry out the purposes and objectives described above it is necessary to <br />acquire the Property Interests. <br /> <br />2. The acquisition of the Property Interests by exercise of eminent domain in the manner <br />provided by Minnesota Statute Chapter 117 serves a public interest and is deemed to be <br />necessary. <br /> <br />RESOLUTION #10-01-021 <br />Page 1 of2 <br />
