The City of Ramsey ordains. <br />SECTION 1. PURPOSE <br />SECTION 2. AMENDMENT <br />3. <br />ORDINANCE #11 -06 <br />CITY OF RAMSEY <br />ANOKA COUNTY <br />STATE OF MINNESOTA <br />AN ORDINANCE AMENDING CITY CODE SECTION TITLED PROPERTY <br />CONDITIONS CONSTITUTING A PUBLIC NUISANCE AND THIS ORDINANCE <br />AMENDING CITY CODE SECTION 2 -332 TITLED ABATEMENT. <br />This Ordinance amends City Code Section 30 -3 titled Property Conditions constituting a public <br />nuisance AND this Ordinance amends City Code Section 2 -332 titled Abatement and relating to <br />the abatement of grass, weeds or noxious growths in excess of eight inches in height. <br />It is the purpose of this Ordinance to (1) amend the City Code's definition of that certain public <br />nuisance relating to the height of grass, weeds or noxious growths of vegetation, and (2) amend <br />the City Code process as it relates to abating the public nuisance of grass, weeds or noxious <br />growths of vegetation which exceed eight inches in height. <br />A. City Code Section 30 -3(10) declaring as a public nuisance grass, weeds or noxious <br />growths of vegetation is amended to provide as follows: <br />All grass, weeds, or noxious growths of vegetation upon public or private <br />property exceeding eight (8) inches in height, or whatever height specified in the <br />appropriate zoning district, excluding acceptable prairie restoration plant <br />materials. <br />B. City Code Section 2 -332 Abatement, paragraph (d).Abatement Procedure (2) Procedure <br />for Public Nuisances a.3 is amended to provide as follows: <br />i. The notice shall also state that failure to abate the nuisance or violation, or request <br />a hearing within the applicable time periods will result in abatement procedures, <br />and that the cost of abatement with penalties and interest will be billed to the <br />property owner. Pursuant to applicable state statutes, any unpaid fees and fines <br />will be charged against the benefited property via special assessment under <br />Minnesota Statutes for certification to the county auditor and collection along <br />with current taxes the following year or in annual installments not exceeding ten, <br />as the council may determine in each case. <br />
