We will be
discussing the possibility of Council adopting an ordinance, pursuant to State
statute. If the ordinance is adopted, it would establish a sewer improvement
taxing district. Council does have the authority to adopt this ordinance by a
4/5 majority vote. The process for adopting an ordinance in Ramsey is: 1)
ordinance introduction; 2) minimum 3 day waiting period before adoption of
ordinance; 3) if adopted, ordinance becomes effective 30 days after first
publication in official newspaper; 4) effectivity interim period allows
opportunity for citizens to request a referendum on the ordinance. In order to
call for a referendum on this ordinance or any city ordinance, 5 citizens must
draft a petition and obtain the signatures of 10% of the registered voters at
the last city-wide election. If the ordinance is adopted and effective,
Council has the authority to "acquire, construct, reconstruct, extend,
maintain, and otherwise improve storm sewer systems and related facilities
within the district." That construction could not occur until Council follows
certain procedures set down in the City Charter (same procedures as in
Minnesota Chapter 429 addressing special assessments). Part of that procedure
includes a public hearing at which time the estimated costs of the improvement
are made known. The same bidding procedures as found in Chapter 429 would also
April 15, 1986
