Councilmember Zimmerman introduced the following resolution and moved for its adoption: RESOLUTION #04-01-017 RESOLUTION APPROVING 2"d PARTIAL PAYMENT TO W.B. MILLER, inc. for IMPROVEMENT PROJECT #03-27 (141sT AVE. NW, AZURITE ST. NW AND BASALT AVE. NW) WHEREAS, on August 26th, 2003, City Council adopted Resolution #03-08-205 approving the plans and specifications for the above referenced work; and WHEREAS, Principal City Engineer Brian Olson inspected the completed work and recommended I st partial payment to W.B. Miller, Inc. in the amount of $155,872.11. WHEREAS, Principal City Engineer Brian Olson inspected the completed work and recommended 2"o partial payment to W.B. Miller, Inc. in the amount of $55,191.68. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the City Council hereby authorizes 2nd partial payment to W.B. Miller, Inc. for Improvement Project #03-27, 141st Ave., NW, Azurite St. NW and Basalt Ave. NW project in the amount of $55,191.68 on January 27, 2004. 2) That the City Council authorizes the Mayor or City Administrator to sign the release form for this payment. 3) That the total amount of this payment is not included in resolutions approving payment of bills for the month of January 2004. 4) That the City of Ramsey Finance Department will be provided a signed copy of this resolution. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Strommen and upon vote being taken thereon, the following voted in favor thereof: Mayor Gamec Councilmember Zimmerman Councilmember Strommen Councilmember Cook Councilmember Elvig Councilmember Kurak Councilmember Pearson and the following voted against the same: Hone and the following abstained: nolle RESOLUTION #04-01-017 Page 1 of 2
