CITY COUNCIL <br />CITY OF RAMSEY <br />ANOKA COUNTY <br />STATE OF MINNESOTA <br /> <br />The Ramsey City Council conducted a work session on Tuesday, March 25, 2003, at the Ramsey <br />Fire Station Number I, 15050 Armstrong Boulevard NW, Ramsey, Minnesota. <br /> <br />Members Present: <br /> <br />Mayor Thomas Gamec <br />Councilmember Todd Cook <br />Councilmember David Elvig <br />Councilmember Patti Kurak <br />Councilmember A1 Pearson <br />Councilmember Sarah Strommen <br />Councilmember Jerry Zimmerman <br /> <br />Also Present: <br /> <br />City Administrator, James E. Norman <br />Director of Public Works/Fire Chief Dean Kapler <br />Police Chief James Way <br />City Attorney William Goodrich <br /> <br />CALL TO ORDER <br /> <br />Mayor Gamec called the work session of the City Council to order at 5:43 p.m. <br /> <br />WORK SESSION TOPICS FOR DISCUSSION <br /> <br />1) Criminal Litigation Pertaining to the Tampering of Fire Department Property <br /> <br />City Attorney Goodrich stated that it had been brought to his attention that the defendant has <br />made calls to some Councilmembers so he was asked to explain the criminal process to the City <br />Council. He explained that the City retains his law firm as their criminal attorney to prosecute <br />criminal violations up to the level of a gross misdemeanor. The process in this case was initiated <br />when a staff member presented the law firm with the facts and asked if what occurred was a <br />violation of the law. As the City's Attorney, Mr. Goodrich determined that what occurred was a <br />violation and the decision was made to proceed with criminal charges at which time a formal <br />complaint was drafted. The complaint was then put before a judge who determined that there was <br />probable cause to proceed with the case. The defendant was given notice to appear in court. At <br />that time the issue is no longer a City matter, but a State of Minnesota matter. That letter was <br />sent to the defendant on January 4, 2003, advising him to appear on February 11, 2003. The <br />defendant failed to appear in court so a warrant was issued for his arrest. The Ramsey Police <br />arrested the defendant for failure to appear and the individual was taken to court and bail was set. <br /> <br />City Council/March 25, 2003 <br /> Page 1 of 5 <br /> <br /> <br />
