ORDINANCE #16-03 <br />CITY OF RAMSEY <br />ANOKA COUNTY <br />STATE OF MINNESOTA <br />AN AMENDMENT TO CHAPTER 117 OF THE CITY CODE, WHICH CHAPTER IS KNOWN AS <br />ZONING AND SUBDIVISIONS OF THE CITY CODE OF RAMSEY, MINNESOTA <br />AN ORDINANCE AMENDING SUBDIVISION VI (WETLAND PROTECTION OVERLAY <br />DISTRICT) AND ARTICLE HI DIVISION 3 (DESIGN STANDARDS AND REQUIRED <br />IMPROVMENTS) OF THE RAMSEY CITY CODE. <br />The City of Ramsey Ordains: <br />SECTION 1 AUTHORITY <br />This ordinance is adopted pursuant to and under the authority of the City Charter of the City of Ramsey. <br />SECTION 2 AMENDMENTS <br />Chapter 117 Subdivision VI is amended to read as follows: <br />Subdivision VI. - Wetland and Storm Water Pond Setback Standards <br />Sec. 117-286. — Incorporation of State Regulations <br />(a) This section hereby incorporates by reference the Wetlands Conservation Act of 1991 of Minn. <br />Statutes § 103G.221 et seq., hereinafter referred to as the WCA, and any future amendments <br />adopted by the legislature. All wetlands and activities shall comply with those regulations as <br />adopted under the WCA. <br />Sec. 117-287. — Findings and Intent <br />(a) The city finds that regulating the use of lands surrounding wetlands and storm water ponds help <br />maintain water quality and the health of these water features. Existing vegetation adjacent to <br />wetlands and storm water ponds help protect their shorelines from erosion while also filtering out <br />sediment, chemicals and other nutrients before storm water discharges into these waters. <br />Protecting the existing vegetation adjacent to wetlands and storm water ponds also helps maintain <br />pollinator friendly habitat. The intent of this subdivision is to establish and maintain a permanent <br />setback from wetlands and storm water ponds throughout the development, building, and <br />landscaping phases of a project to ensure the land within this setback is left undisturbed in its <br />natural condition. <br />Sec. 117-288. — Purpose and Implementation <br />
