Councilmember Kurak introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #02-01-019 <br /> <br />RESOLUTION ESTABLISHING A POLICY TO REQUIRE THE DELINEATION AND <br />ENCUMBRANCE OF WETLANDS ON ALL PLATS <br /> <br /> WHEREAS, the past practice in the City has been to require the delineation and <br />encumbrance of wetlands with drainage easements on all plats; and <br /> <br /> WHEREAS, the purpose of encumbering wetlands with drainage easements is to provide <br />the City with the ability to run water over or through the area; and <br /> <br />WHEREAS, delineation of wetlands also identifies the buildable limits of a parcel; and <br /> <br /> WHEREAS, on October 23, 2001, the City Council directed City Staff to research <br />whether or not wetland delineation and encumbrance is necessary and draft a written policy for <br />consideration. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, SATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />2) <br /> <br />3) <br /> <br />That the presence of any public or private drainage ditches shall be identified on all plats <br />and encumbered within a sixty-six foot wide drainage and utility easement. <br />That the delineation of wetlands and encumbrance of wetlands with public drainage and <br />utility easements shall be required on all plats, except that any lots proposed to be 10 <br />acres or more in size that are located in plats that are outside the boundaries of the <br />Metropolitan Urban Service Area shall be exempt from the wetland delineation and <br />encumbrance requirement. This exemption does not supercede the City's authority to <br />require the establishment of drainage easements, if necessary, over the proposed method <br />of conveying and disposing surface water drainage within and beyond the limits of the <br />plat to publicly owned or controlled drainage facilities or storm sewers. This exemption <br />also does not supercede Section 9.50.30 (Subdivision Design Standards), Subd. 4b <br />(Easements) of the Ramsey City Code which establishes that where a subdivision is <br />traversed by a water course, drainage way or stream, a drainage easement conforming <br />substantially with the lines of such water course shall be provided, together with such <br />further width or construction, or both, as shall be adequate for storm water drainage of <br />the area. <br />That City Staff shall initiate action necessary to establish this wetland delineation and <br />encumbrance policy as a requirement in the Zoning and Subdivision Chapter of City <br />Code. <br /> <br /> <br />
