Councilmember Riley introduced the following resolution and moved for its adoption: RESOLUTION #22-017 RESOLUTION APPROVING RIVERSTONE OUTLOT OWNERSHIP WHEREAS,Riverstone Development LLC,hereafter referred to as"Developer",properly received Preliminary Plat and subsequent Final Plat approvals for a development known as Riverstone; and WHEREAS,the development platted various outlots; and WHEREAS,the Developer maintains ownership of some outlots; and WHEREAS, the City has historically been provided drainage and utility easements over necessary outlots with ownership of the outlots being privately owned; and WHEREAS,the development has an active Homeowners Association; and WHEREAS, staff reviewed documents related to the implementation of the Homeowners Association, but the documents did not identify the Homeowners Association to maintain ownership of all outlots; and WHEREAS, the Developer has requested the City of Ramsey take ownership of the following outlots: • Riverstone, Outlot D • Riverstone 4th, Outlots E, G, H • Riverstone 5th, Outlots A, B WHEREAS, staff recognizes a public purpose for the above reference outlots with no benefit to the Developer; and WHEREAS, staff recommends the following condition to accept ownership of the above referenced outlots: • The Developer pay in full any outstanding taxes owed NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, COUNTY OF ANOKA, STATE OF MINNESOTA, as follows: 1) That the City Council of Ramsey hereby approves, subject to conditions identified in paragraph 2, the ownership of the following outlots in the Riverstone development: • Riverstone, Outlot D • Riverstone 4 h, Outlots E, G, H • Riverstone 5 h, Outlots, A, B 2) Conditions of ownership of the above referenced outlots as follows: 0 The Developer pay in full any outstanding taxes owed
