Councilmember Van Wagner introduced the following resolution and moved for its adoption: RESOLUTION #82-5 RESOLUTION REGARDING OUTLOTS "A" AND "B" OF COUNTRYSIDE ESTATES AND OUTLOT "A" ROLLING GREEN ADDITION WHEREAS, the City of Ramsey has recently surfaced the streets within the Countryside Estates plat; and WHEREAS, the City Engineer has determined that approximately one-third of the area in Countryside Estates drains towards Outlot "B" in said plat; and WHEREAS, during periods of heavy rain or fast snowmelt, the area could experience flooding without additional ponding areas; and WHEREAS, the owner of Outlot "B" in Countryside Estates has agreed to deed the South half of said Outlot to the City with the condi- tion that he be granted a variance from the subdivision ordinance to sub- divide Outlots A and B Countryside Estates and Outlot A in the Rolling Green Addition; and WHEREAS, the above proposed subdivisions would not result in lot sizes that are all smaller than presently exist in the area. NOW THEREFORE, BE IT RESOLVED THAT THE CITY AGREES TO ACCEPT THE SOUTH HALF OF OUTLOT "B" COUNTRYSIDE ESTATES WITH THE FOLLOWING CONDITIONS: 1) That the City of Ramsey shall waive all subdivision fees involving subdividing by metes and bounds and park fees on the above des- cribed outlots. 2) That the City shall waive the area and frontage require- ments of the City Code for the subdivision of the above described out- lots. 3) That in the subdivision of Outlot A Rolling Green Addition, the developer shall agree to the following: a) Provide adequate soils information to prove to the City that there are two buildable lots under the present City ordinance requirements. b) Easements be provided to handle the drainage from the Rolling Green Addition as determined by the City Engineer. If the Outlot is subdivided, it is the in- tent that the easemenet be placed along the proposed subdivision line.
