Mayor Heitman introduced the following resolution and moved for <br />its adoption: <br /> <br />RESOLUTION #85-24 <br /> <br />RESOLUTION REGARDING WASTE MANAGEMENT, INC. REQUEST FOR TEMPORARY <br />CONDITIONAL USE PERMIT <br /> <br /> WHEREAS, Waste Management, Inc. made an application on <br />November 11, 1984 for a mining permit on the following legally <br />described properS: <br /> <br />The South Half of the Northeast Quarter of Section <br />27, Township 32, Range 25, Anoka County, <br />Minnesota. <br /> <br /> WHEREAS, Waste Management, Inc. did appear before the <br />Ramsey City Council on November 13, 1984, during citizen input to <br />request a temporary conditional use permit. At the meeing, staff <br />wasn't sure what the legal requirements would be for a mining <br />permit. Council consensus was they should apply for a <br />conditional use permit; and <br /> <br /> WHEREAS, City Attorney's memo dated November 24, 1984, <br />stated that the issuance of a mining permit would require Council <br />to issue a temporary conditional use permit. This would not <br />require a public hearing. However, he further stated Council may <br />conduct a public hearing before issuing said permit; and <br /> <br /> WHEREAS, the Ramsey City Council at their regular <br />meeing of November 27, 1984, did by motion decide not to hold a <br />public hearing on the issuance of a temporary conditional use <br />permit for Waste Management to mine in the above stated area; and <br /> <br /> WHEREAS, Waste Management, Inc. did appear before the <br />Planning and Zoning Commission on December 4, 1984 for input on <br />their request for a temporary conditional use permit. The <br />Planning and Zoning Commission concensus was as follows: <br /> <br />a) the permit should restrict public access to <br />properS, <br /> <br />b) that the City is not allowing any expansion <br />beyond existing licensed landfill facility located <br />north of subject property <br /> <br /> WHEREAS, at the regular Council meeting of December 11, <br />1984, the citizens requested that the Council bold a public <br />hearing prior to the granting of a temporary conditional use <br />permit to Waste Management, Inc. for the purpose of mining; and <br /> <br /> WHEREAS, the City Council after hearing the citizens <br />comments adopted a motion requesting that the Waste Management, <br />Inc. request for temporary conditional use permit be placed on <br />the Councils agenda for its first meeting in January, 1985 and <br />that a public hearing be held on it; and <br /> <br />Page 1 of Z <br /> <br /> <br />
