Councilmember Peterson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #91-01-013 <br /> <br />RESOLUTION APPROVING PAYMENT FOR LAND <br />TO MYRON I. WELTE FOR PROPERTY TAKEN <br />WATER EXTENSION TO RIVLYN AVENUE N.W. <br /> <br />ACQUISITION DAMAGES <br />FOR THE SEWER AND <br /> <br /> WHEREAS, the City has authorized acquisition of right-of-way for the construction of <br />the extension of Rivlyn Avenue N.W. and sewer service along Rivlyn Avenue N.W., all for City <br />Improvement Project #89-13; and <br /> <br /> WHEREAS, the City has constructed the sewer line and requires a permanent 15 foot <br />wide easement over and across Mr. Welte's property, which is a part of Lot 3, Auditor's <br />Subdivision No. 96 and PIN R35-32-25-22-0004; and <br /> <br /> WHEREAS, Staff has negotiated a settlement with landowner Myron I. Welte and which <br />proposed settlement is $1,750.00, which amount is consistent with that paid to other affected <br />landowners. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE RAMSEY CITY COUNCIL, <br />COUNTY OF ANOKA, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the City's Finance Officer is directed to issue a check to Myron I. Welte, owner of <br />Parcel No. 3 of City Improvement Project #89-13 in the amount of $1,750.00. <br /> <br />2) <br /> <br />That the City Attorney is directed to deliver said check upon receipt by him of the proper <br />title transfer documents from the landowner, including mortgage release documents. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Cich and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gilbertson <br />Councilmember Beyer <br />Councilmember Cich <br />Councilmember Hardin <br />Councilmember Peterson <br /> <br />and the following voted against the same: <br /> <br />None. <br /> <br />and the following abstained: <br /> <br />None. <br /> <br />and the following were absent: <br /> <br />None. <br /> <br /> <br />
