ORDINANCE #89-25 <br /> <br /> CITY OF RAMSEY <br /> ANOKA COUNTY <br />STATE OF MINNESOTA <br /> <br />AMENDMENT TO CHAPTER 210.2 known as the Water and Sewer Utilities <br />Chapter of the City Code. <br /> <br />AN ORDINANCE AMENDING SECTION 210.2 of the City Code. <br /> <br />SUMMARY <br /> <br />An ordinance amending the Water and Sewer Utilities chapter <br />defining when sanitary sewer service is determined to be available. <br /> <br />The city of Ramsey ordains: <br /> <br />SECTION 1. AMENDMENT <br /> <br /> Section 210.2 of the Ramsey City Code pertaining to <br />Applications for Service, Subdivision 3 is repealed and is amended <br />to read as follows: <br /> <br />The owner of all dwellings, buildings, other structures or <br />properties where cesspools or septic tanks have been in <br />existence prior to construction of a sanitary sewer shall <br />connect with the public sanitary sewer when such cesspools and <br />septic tanks are in need of repair, reconstruction or pumping, <br />or within two (2) years of the date that municipal sanitary <br />sewer service is available to the premises, whichever is first <br />to occur. Municipal sanitary sewer service shall be <br />determined to be available to the premises when trunk or <br />lateral sewer occupies the right-of-way or easement adjacent <br />to or on the property. In the event that the City Council <br />finds that hookup to municipal sewer is not feasible due to <br />distance, topography, physical barrier or pending land use <br />change; sewer connection shall not be required until such <br />condition changes thereby allowing for feasible connection. <br /> <br />SECTION 2. EFFECTIVE DATE <br /> <br /> This Ordinance becomes effective upon its passage and thirty <br />(30) days after is publication according to law, subject to City <br />Charter Provision, Section 5.04. <br /> <br /> PASSED, by the City Council of the City of Ramsey, Minnesota <br />on the 26th day of September , 1989. <br /> <br /> <br />
