ORDINANCE #88-10 <br /> <br /> CITY OF RAMSEY <br /> ANOKA COUNTY <br />STATE OF MINNESOTA <br /> <br />AMENDMENT TO CHAPTER 130 WHICH IS KNOWN AS THE BUSINESS AND TRADE CHAPTER <br />OF THE CITY CODE OF RAMSEY, MINNESOTA. <br /> <br />AN ORDINANCE AMENDING CHAPTER 130 OF THE BUSINESS AND TRADE CHAPTER OF THE <br />RAMSEY CITY CODE BY THE ADDITION OF SECTION 130.12 ENTITLED "CHARITABLE <br />GAMBLING". <br /> <br />The City of Ramsey ordains: <br /> <br />SECTION 1. AMENDMENT. <br /> <br />130.121. In general. Lawful gambling conducted pursuant to Minnesota <br />Statutes, Chapter 349 shall be operated in accordance with the conditions <br />prescribed in this chapter and other applicable provisions of the Ramsey <br />City Ordinances. <br /> <br />130.122. Notice; approval or disapproval. The applicant for a gambling <br />license shall notify the City Council in writing in the manner required <br />by law of each pending application for a charitable gambling license at <br />least sixty (60) days before issuing or renewing the license. Each <br />pending application for a license shall be approved or disapproved by the <br />City Council. <br /> <br />130.123. Location. Lawful gambling under license issued by the <br />Minnesota Charitable Gambling Control Board may be conducted only at <br />locations that comply with applicable zoning, building, fire, and health <br />codes of the City of Ramsey. Ail applications must be for a specific <br />location with the exception of Class D (raffle only) licenses. <br /> <br />The following locations are considered unsuitable for gambling operations <br />and any request for a gambling license at such a location will be <br />rejected without clear and convincing evidence that such a location will <br />not pose undue enforcement difficulties, lessen property values of <br />adjoining properties, or expose gambling to persons under eighteen (18) <br />years of age: <br /> <br />(a) Areas zoned for agriculture or residential use; <br /> <br />(b) Locations where the predominant clientele is under the age of <br />eighteen (18) years of age; <br /> <br />130.124. Conditions. The conduct of lawful gambling under license issued <br />by the Minnesota Charitable Gambling Control Board shall be subject to the <br />following conditions in the City of Ramsey: <br /> <br />(a) No organization shall be eligible for a gambling license unless, for <br />the three (3) years immediately preceding the date of application, it has <br />demonstrated that during that period it has performed substantial services <br />within the City of Ramsey or on behalf of residents of Ramsey; <br /> <br /> <br />
