ORDINANCE NO. 90-23 <br /> CITY OF RAMSEY <br />ANOKA COUNTY, MINNESOTA <br /> <br />AN ORDINANCE AMENDING CHAPTER 9 OF THE CITY CODE OF THE CITY <br />OF RAMSEY RELATING TO RULES OF CONSTRUCTION AND <br />INTERPRETATION; THE DEFINITION OF ADULT USES, AMORTIZATION, <br />NONCONFORMING USE AND NONCONFORMING STRUCTURE; <br />PROCESSING COSTS; THE PROCEDURAL REQUIREMENTS FOR <br />CONDITIONAL USE PERMITS AND VARIANCES; THE PROCEDURAL <br />REQUII~EMENTS AND MEMBERSHIP OF THE BOARD OF ADJUSTMENT AND <br />APPEALS; PROCESSING COSTS FOR CONDITIONAL USE PERMITS AND <br />VARIANCES; THE REGULATION OF NON-CONFORMING BUILDINGS, <br />STRUCTURES AND USES; PERFORMANCE STANDARDS FOR ADULT USES; <br />THE REVISION OF ACTIVITIES WITHIN THE B-l, B-2, RB, I, AND RI <br />ZONING DISTRICTS; PERFORMANCE STANDARDS FOR NON.RESIDENTIAL <br />USES; THE REPEAL OF DUPLICATE REFERENCES IN ALL ZONING <br />DISTRICTS; THE CREATION OF THE B-3, HIGHWAY BUSINESS DISTRICT <br />AND THE B-W, BUSINESS/WAREHOUSING DISTRICT, AND THE REZONING <br />OF CERTAIN LANDS TO B-W AND B-3 ZONING DISTRICTS. <br /> <br />The City of R~msey ordains: <br /> <br />Section 1. Amendment. That Chapter 9, §9.01.06 Rules shall be amended to <br />read as follows: <br /> <br />9.01.06 Rules of construction nnd interpretation. <br /> <br /> Subdivision 1. Conflicting conditions. Where the conditions imposed <br />by any provision of this Chapter are either more or less restrictive than <br />comparable conditions by another provision of this Chapter or by other Chapters of <br />the City Code, rule or regulation of the City, the provision which imposes the more <br />restrictive condition, standard, or requirement shall prevail. <br /> <br /> Sub& 2. Language rules of construction. The language set forth in <br />the text of this chapter shall be interpreted in accordance with the following rules <br />of construction: <br /> <br />The singular number includes the plural, and the plural the <br />singular. <br /> <br />The present tense includes the past and future tenses, and the <br />future the present. <br /> <br />The word "shall" is mandatory while the word "may" is per <br />missive. <br /> <br />The masculine gender includes the feminine and neuter. <br /> <br />Whenever a word or term defined hereinafter appears in the text <br />of this chapter, its meaning shall be construed as set forth in the <br />Definitions section of this chapter. <br /> <br />Ord. 90-23 Final 11/13/90 Page I <br /> <br /> <br />
