ORDINANCE #95-04 <br /> <br />CITY OF RAMSEY <br />ANOKA COUNTY <br />STATE OF MINNESOTA <br /> <br />AMENDMENT TO CHAPTER 7 WHICH IS KNOWN AS THE LICENSING AND <br />PERMITS CHAPTER OF THE CITY CODE <br /> <br />AN ORDINANCE AMENDING CHAPTER 7, SECTION 7.13 ENTITLED <br />"PAWNBROKERS" OF THE CITY CODE OF RAMSEY, MINNESOTA <br /> <br />The City Council of the City of Ramsey Ordains: <br /> <br />SECTION 1. <br /> <br />AMENDMENTS <br /> <br />The definition of "Pawnbroker" contained in Section 7.13.01 is amended to read as <br />follows: <br /> <br />~ A person who loans money on deposit or pledge of personal property or <br />other valuable thing; who deals in the purchasing of personal property or other valuable <br />thing on condition of selling the same back again at a stipulated price; or who loans money <br />secured by chattel mortgage or by personal property, taking possession of the property or <br />any part thereof so mortgaged. To the extent that a pawnbroker business includes buying <br />personal property previously used, rented, or leased, the provisions of this Section shall be <br />applicable. Any bank, savings and loan association, or credit union shall not be deemed a <br />pawnbroker for purposes of this Section. <br /> <br />B. Section 7.13.02 is amended to provide as follows: <br /> <br />7.13.02 GENERAL <br /> <br />Subdivision. 1. <br /> <br />PI,,JRPO;$E <br /> <br />The Council finds that pawnbrokers potentially provide an opportunity for the commission <br />of crimes and their concealment because such businesses have the ability to receive and <br />transfer stolen property easily and quickly. The Council also finds that consumer <br />protection regulation is warranted in transactions involving pawnbrokers. The purposes of <br />this Section is therefore to prevent pawnbroking from being used as facilities for <br />commission of crimes and to assure that such businesses comply with basic consumer <br />protection standards, thereby protecting the public health, safety, and general welfare of the <br />citizens of the City. <br /> <br />Subd. 2. LICENSE REOUIRED <br /> <br />No person, partnership, or corporation shall engage in or carry on the business of a <br />Pawnbroker or Secondhand Goods Dealer, without a license issued by the City, for each <br />and every separate office or place of business operated by such licensee in the City. The <br />annual fee for such license shall be set by Council resolution. <br /> <br />A license under this Section shall authorize the licensee to carry on its business only at the <br />permanent place of business designated in the license. No license may be transferred to a <br />different location or a different licensee. <br /> <br /> <br />
