ORDINANCE #86-11 CITY OF R&MSEY AN(FA COUNTY STATE OF MINNESOTA AN ORDINANCE ESTABLISHING A STOI~M SEWER IMPROVEMENT TAX DISTRICT IN THE CITY OF RAHSEY, ANOKA COUNTY, MINNESOTA. The City of Ramsey Ordains: Section 1. ~ The City of Ramsey is authorized by Minnesota Statutes, Sections 444.16 through 444.21 (the Act) to establish storm sewer improvement tax districts for the purposes of constructing and financing storm sewers and related facilities. Section 2. F,..JJld~zg~ The City hereby finds and determines that it is necessary and desireable for the health, safety and welfare of its residents and for the proper control of storm drainage and flooding in the City to use the authority contained in the Act to establish a storm sewer improvement tax district (the District). The purpose of the District shall be to finance through a tax the cost of acquisition, construction, reconstruction, extension, maintenance and other improvements to storm sewer systems and related facilities within the District as prescribed in the Act. The City Council futher finds: (1) that those properties of the City legally described, in Section 4 herein have already established and paid for storm sewer improvements and that it is inequitable to include these properties in the Drainage District at this 'time; and (2) that it is equitable to include into the Drainage District the properties excluded in Section 4 herein after a period of five (5) years from the date hereof. Section 3. Boundaries of District The Mississippi River Drainage District is established. The boundaries of the district are as follows: See attached Exhibit "A" containing legal desciption. Section 4. ~ The following properties, because they have already established and paid for storm sewer improvements are hereby excluded from the storm sewer taxing district established until September 1, 1991. These excluded properties are legally described as follows, to-wit: See attached Exhibit "B" containing legal description. On and after September 1, 1991, the properties described above in this Paragraph 4 shall be automatically included in the Mississippi Drainage District as established by this Ordinance.
