ORDINANCE NO. 79-3 <br /> <br />AMENDMENT TO CHAPTER 170.04 OF THE CITY CODE <br /> OF RAMSEY, ~I[NNESOTA <br /> <br />AN ORDINANCE AMENDING CHAPTER 170.04 ENTITL~D "SOILS" <br /> <br />SECTION 1. Amendments <br /> <br />Section 170.041(4) is hereby amended to read as follows: <br /> <br />170. 041 PURPOSES AND FINDINGS <br /> <br /> 4. The city adopts the standard requir~t that sufficient area of <br />Class I land be available within each lot or parcel for the construction <br />of an adequately sized soil absorption system and the reconstruction or <br />duplication of the soil absorption or final disposal unit of that system. <br />In no case shall the area of contiguous Class I land available on each lot <br />be less than as follows: <br /> <br />a. 1990 Urban Area <br />b. Transitional Area <br />c. Rural Area <br /> <br />50% of lot area <br />25% of lot area <br />25% of lot area <br /> <br />Ail areas shall be exclusive of public rights of way, including publicly <br />dedicated easements. All required areas of contiguous ClassI land avail- <br />ability may include that portion of the lot or parcel used for building <br />construction and all such areas may include building set-back requirements, <br />except that there must be adequate area for septic tank construction in the <br />1990 Urban Development Area and adequate area for septic tank consf_ruction <br />and reconstruction in the Transitional and Rural Development Areas. <br /> <br /> Section 170. 046 is hereby added to Chapter 170.04 and said section shall read as <br />follows: <br /> <br />170.046 LOTS OF RECORD <br /> <br /> This chapter is intended to apply to all parcels of land within the <br />City of Ramsey, regardless of whether a parcel was of record before or after <br />the time of enactment of this chapter. <br /> <br /> Section 170. 047 is hereby added to Chapter 170.04 and said section shall read as <br />follows: <br /> <br />170. 047 VARIANCES <br /> <br /> Variances from the strict enforcement of this chapter may be granted <br />in accordance with the procedures and requir~ts of the variance section of <br />the zoning chapter of this code, which is specifically Section 170.018. <br /> <br /> <br />
