ORDINANCE NO. 78-6 <br /> <br /> CHAPTER t10.19 - CITY OF RAMSEY CODE CONDITIONS OF PREMISES <br /> <br />AN ORDINANCE CREATING CHAPTER 110.19 OF T~IE CITY OF RAMSEY CODE, WHICH ORDINANCE IS <br />ENTITLED: CONDITION OF PREMISES <br /> <br />The Council of the City of Ramsey ordains: <br /> <br />SECTION 1. <br /> <br />110.191 PREAMBLE <br /> <br /> It is hereby determined that the uses, structures and activities and causes <br />of blight or blighting factors described in this chapter, if allowed to exist, will <br />tend to result in blighted and undesirable neighborhoods so as to be harmful to the <br />public welfare~ health and safety. No person shall maintain or permit to be main- <br />tained any of these causes of blight or blighting factors upon any property in the <br />City owned~ leased, rented or occupied by such person: <br /> <br /> (a) In any area zoned for residential purposes, the storage upon any property <br />of junk automobiles. For the purpose of this section, the term "junk automobiles" <br />shall include any motor vehicle, part of a motor vehicle or former mo%or vehicle, <br />stored in the open, which is not currently licensed for use upon the highways of the <br />state, and is either (1) unusable or inoperable because of lack of, or defects in <br />component parts; or (2) unsusable or inoperable because of damage from collision, <br />deterioration or having been cannibalized; or (3) beyond repair and therefore not <br />intended for future use as a motor vehicle; or (4) being retained on the property for <br />possible use of salvageable parts. <br /> <br /> (b) In any area zoned as a residential district, highway business or general <br />business district the storage or accumulation of junk, trash, rubbish or refuse of <br />any kind, except refuse stored in such a manner as not to create a nuisance for a <br />period not to exceed thirty days. The term "junk" shall include parts of machinery <br />or motor vehicles, unused stoves or other appliances stored in the open; remnants of <br />wood; decayed, weathered or broken construction materials no longer suitable for safe, <br />approved building materials; metal or any other material or cast off material of any <br />kind whether or not the same could be put to any reasonable use. <br /> <br /> (c) In any area the existence of any structure or part of any structure which <br />because of fire, wind, or other natural disaster, or physical deterioration is no <br />longer habitable as a dwelling, nor useful for any other purpose for which it may have <br />been intended. <br /> <br /> (d) In any area zoned for residential purposes, the existence of any vacant <br />dwelling, garage or other out-building, unless such buildings are kept securely locked, <br />windows kept glazed or neatly boarded up and otherwise protected to prevent entrance <br />thereto by vandals. <br /> <br />110.192 POWERS OF OFFICERS <br /> <br /> Whenever in the judgment of the health authority, zoning officer, or chief of <br />police (or such other officers as may be determined by the administrative assistant), <br />he finds upon investigation that a blight condition is being maintained or exists within <br />the City of Ramsey and within the respective fields of supervision as hereinbefore set <br />forth~ they shall issue written notice to the owner or occupant an~ r~quire him ~o <br />terminate and abate said blight condition or to remove such conditions or remedy such <br />defects. Service of said notice shall be in person or by mail. If the premises are <br />not occupied and the address of the owner is unknown, service on the owner may be had <br />by posting a copy of the notice on the premises. If said blight condition is not abated <br />within ten (10) days of the date of issuance of said notice, the city official issuing <br />said notice shall issue a code violation to the notified owner or occupant. <br /> <br /> <br />
