ORDINANCE NO. 78-2 <br /> <br />CHAPTER 130.09 - CITY OF RA~EY CODE <br /> <br />INTOXICATING LIQUORS - OFF-SALE, PRIVATE CLUB <br /> AND ON-SALE WINE LICENSES <br /> <br />AN ORDINANCE LICENSING AND REGULATING THE SALE AND CONSUMPTION OF INTOXICATING LIQUOR <br />AND PROVIDING A PENALTY FOR VIOLATION. <br /> <br />The Council of the City of Ramsey ordains: <br /> <br />130.091 - Provisions of State Law Adopted. The provisions of Miranesota Statutes, <br />Chapter 340, relating to the definition of terms, licensing, consumption, sales, con- <br />ditions of bonds of licensees, hours of sale, and all other matters pertaining to the <br />retail sale, distribution and consumption of intoxicating liquor are adopted and made <br />a part of this ordinance as if set out in full. <br /> <br />130.092 - License Required. <br /> <br /> 1. General Requirement. No person, except a wholesaler or manufacturer to the <br />extent authorized under state license, shall directly or indirectly deal in, sell or <br />keep for sale in the City and any intoxicating liquor without a license to do so as <br />provided in this ordinance. Liquor licenses shall be of three kinds: "on-sale", <br />"off-sale", and "club licenses". <br /> <br /> 2. On-Sale Licenses. The requirements for issuance of "on-sale" licenses are <br />those found in Chapter 130.05 of this Code. <br /> <br /> 3. On-Sale Wine Licenses. "On-sale" wine licenses shall be issued only to <br />restaurants meeting the qualifications of ~inmesota Statutes, Section 340.11, Sub- <br />division 20 and shall permit only the sale of wine not exceeding 14 per cent alcohol <br />by volume, for consumption on the licensed premises only, in conjunction with the <br />sale of food. Applications for an "on-sale" wine license shall follow the appli- <br />cation requirements of Chapter 130.05, Regulations for the sale of "on-sale" wine <br />shall be those regulations as provided in Chapter 130.05 of this Code. <br /> <br /> 4. Special Club Licenses. Special club licenses shall be issued only to incor- <br />porated clubs which have been in existence for 15 years or more or to congressionally <br />chartered veterans' organizations which have been in existence for 10 years. Appli- <br />cations shall be made on forms as prescribed by the City Council. <br /> <br /> 5. Off-Sale Licenses. "Off-sale" licenses shall be issued only to drug stores <br />and exclusive liquor stores and shall permit "off-sale" of liquor only. No "off- <br />sale" license shall be issued to an exclusive liquor store holding an "on-sale" <br />liquor license. The City may issue a maximum of two (2) "off-sale" licenses. <br /> <br />130.093 - Application for License to be Verified. Every application for an "off- <br />sale" license shall be verified and filed with the City clerk-treasurer. <br /> <br />130.O94 - Contents of Application.
