Councilmember Peterson introduced the following resolution for its adoption: RESOLUTION #92-01-019 RESOLUTION REVOKING CONDITIONAL USE PERMIT ISSUED 14600 NOWTHEN BLVD. N.W. (PIN 25-32-25-23-0006) FOR AN AUTO SALES/REPAIR OPERATION TO WHEREAS, on December 17, 1985, the City of Ramsey approved issuance of a conditional use permit to Mr. Gerald Root (Permit Holder) for an auto sales/repair operation on the property generally known as 14600 Nowthen Blvd. N.W. and legally described as follows: That part of the Southwest Quarter of the Northwest Quarter of Section 25, Township 32, Range 25, Anoka County, Minnesota, described as follows: Commencing at the West Quarter corner of said Section 25, thence 90 degrees 00 minutes east, along the south line of said Northwest Quarter, a distance of 829.6 feet; thence north 30 degrees 49 minutes 30 seconds west, a distance of 401.96 feet; thence north 29 degrees 55 minutes 10 seconds west a distance of 214.2 feet to the actual point of beginning; thence continuing north 29 degrees 55 minutes 10 seconds west a distance of 288.37 feet, thence north 60 degrees 04 minutes 50 seconds east, a distance of 247.03 feet more or less, to the center line of County State Aid Highway No. 5; thence south 29 degrees 55 minutes 10 seconds east, along the centerline of said Highway No. 5, a distance of 416.97 feet; thence south 87 degrees 34 minutes 50 seconds west, a distance of 278.5 feet, more or less, to the point of beginning. and; WHEREAS, the terms of the conditional use permit were amended and the City of Ramsey approved issuance of an amended conditional use permit on February 24, 1987, which conditional use permit supercedes that issued on December 17, 1985; and WHEREAS, the City of Ramsey has written correspondence and photographs on file documenting violations of the terms of the conditional use permit issued in 1985 and the amended conditional use permit issued in 1987; and WHEREAS, on November 29, 1991, in accordance with Section 9.03.04 of the Ramsey City Code, the City of Ramsey provided the Permit Holder with written notification to correct the violations within 30 days; and WHEREAS, on January 28, 1992, the Ramsey City Council conducted a public hearing and adopted Findings of Fact #0305 to consider revocation of the subject conditional use permit. NOW THEREFORE, BASED ON FINDINGS OF FACT #0305 ADOPTED ON JANUARY 28, 1992, THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, resolves as follows: The conditional use permit approved for issuance on February 24, 1987 to Mr. Gerald Root at 14600 Nowthen Blvd. N.W. (PIN 25-32-25-23-0006) for an auto sales/repair operation is hereby revoked. o The Permit Holder is hereby given 90 days from the date of this resolution to cease and desist all auto sales/repair activities on the subject property.
